<p><b>Answer:</b> John, the attorney's advise is most likely your only option due to your current financial situation. </p>
<p>If you had paid a small amount of your mortgage each month and at least spoke to the lender when they called, you might have staved off the foreclosure proceedings. Now there are only two ways to stop it, file BK or pay up.

<p><b>Answer:</b> You need to consult a bankruptcy attorney, this is serious business.  It makes sense to say that you can include that judgment in your bankruptcy but then again it is a court ordered judgment so I don't know if they have ways of enforcing it.

I contacted the agent in charge of the property and told them I'm interested in renting the property from Fannie Mae and he told me I was better off moving instead. What can i do to find out more i tried calling Fannie Mae and was told i need to get the info from the agent in charge of the property please help<br />

<p><b>Answer:</b> You don't say where you are located, and Fannie Mae may have more incentive to rent a foreclosed property in your area than where I am.  </p>
<p>I suggest that you call the agent again, and get his/her address and send, in writing, your interest in renting the property.  You might send a copy of the letter to the agent's broker and if you have a mailing address, send it to Fannie Mae as well.  [If you work your way through the Fannie Mae system, you may even be able to get the name of the representative who handles the foreclosure properties in your area.]</p>
<p>Things have changed a lot since I was an asset manager for Fannie Mae properties for my broker.  It is possible that if the property is rented out, the agent may have to service the rental listing which is a pain if s/he is a selling agent and receive a minimal fee for the effort.  Or, the agent may have the property removed from his/her inventory and not have the chance to sell it and actually earn a commission.</p>
<p>Or, the agent may be a straight shooter.  And actually helping you by saying that dealing with Fannie Mae as a LL is a major pain.  </p>
<p>Only one way to find out.</p>

Yes, I am still pursuing legal action for this situtation.</p>
<p>OK, so  I only stopped paying on the house, and it apparently (one year later) just sold in a foreclosure auction. I now have a foreclosure on my credit report, which I know will be there for 7 years. All of my revolving credit cards are paid on time and usually in full. I have money in the bank. So basically, everything else is in tact but *the house*.<br />
Who do I call to repair my credit? Debt consolidation company, bankruptcy attorney (even though I am NOT filing for bankruptcy)? Is time my only option?<br />
How do I repair it if my only debt is the house?<br />
Let me know if you know the answer to this because I am confused.

This process of recouping the loss of mortgage is termed as foreclosure. The lender or the banker files a &ldquo;foreclosure petition&rdquo; in the local tribunal courts and the legal proceedings are carried forward by the court and county sheriff. If there is no justifiable response from the mortgagee, the county sheriff would carry out the court order for auction and all proceedings from the sale will be disbursed according to the claims arbitrated by the lender.</p>
<p>While foreclosure attempts to reimburse the lender of the loan amount, the mortgagee usually looses out heavily through his credit score. Foreclosure, is the second worst credit nightmare, which can bring down a defaulted mortgagee&rsquo;s score drastically. So, if you are one who is struggling to make mortgage payments or find yourself in troubling situation due to your divorce, then I would recommend you opt for quick sale. A quick sale can provide you both with cash and salvation from the consequences of foreclosure. One of the safest and easiest quick sales that I know of is a Cashout option. While it does not appear that prices will improve this year, there are indications that the market may begin to experience some recovery next year. This could mean an improvement in prices which have appeared to be in free fall for the last few months. One of the reasons that it is anticipated that prices will begin to improve in 2009 is the fact that many experts have anticipated the market will bottom out in 2008. At first glance, this can certainly seem to be frightening news but, it is important to keep in mind that the market really cannot begin to recover until it does bottom out.</p>
<p>In understanding the recovery of the market it is important to look at the factors that resulted in the current real estate market slump. There are actually several factors that led to the current slump. One of the most important factors is the fact that prices in several areas throughout the country doubled between 2000 and 2005. In some cases, those prices even tripled. As a result, there were a record number of people who were unable to afford homes, especially first-time home buyers. As the number of buyers able to purchase real estate began to dwindle, resulting in price and sales declines throughout the country.</p>
<p>As headlines have proclaimed recently, subprime loans also contributed to the recent debacle. During the last few years, a large percentage of the number of loans that were made was issued to buyers with credit scores that were below average. Additionally, a large number of loans were made to buyers with minimal down payments. Approximately two years ago real estate prices stopped rising. At this time, a number of buyers who had snapped up houses in red hot markets suddenly discovered that the balance of their mortgage exceeded their home's values.</p>
<p>The rate of defaults began to escalate at this point. Before long, foreclosures also began to increase as a direct result. As more and more foreclosures hit the market, the inventory in many markets began to spiral out of control. As more homes hit the market, prices began to drop even more. To make matters even worse, economic growth began to stall and massive layoffs in many areas further fueled defaults and foreclosures.</p>
<p>While it has taken some time, assistance is now being provided to homeowners; which is anticipated will help to stave off the increasing rate of foreclosures. Overall, this is anticipated to help stabilize the rapidly rising inventory of homes for sale throughout the nation.</p>
<p>It is important to keep in mind that while headlines appear to be constantly blasting news about the softening market, there are actually some markets in the country where prices have continued to rise rather than decline. On average, real estate prices nationwide are approximately 5% less than they were last year; however, many of the metro areas in the nation are still experiencing price increases. <p><b>Answer:</b> First, you can't transfer title to the house while you have a loan against it as that would allow the bank to demand immediate payoff in full.  And then you've just accelerated the foreclosure process.  Second, even if the house were held in a trust, that would not impact the bank's right to foreclose.  All that would happen is that any money left after the house is sold and the loan is satisfied would go into the trust.</p>

<p>The foreclosure process may be initiated when a given property owner defaults on his or her mortgage loan. It is initiated by the lender and can result in the seizure and sale of the property. There are different stages of the foreclosure process to consider. These stages present the borrower with opportunities to bring the loan back to a current standing and negate the foreclosure. The time periods for each stage may vary from state to state as well.</p>

<p>After a specified time period, normally 90 days, the lender files a Notice of Default at the Circuit Court in the county in which the property is located. This serves as an alert to the borrower that the foreclosure process is beginning. This should come as no surprise in the vast majority of cases. <p>The Notice of Default also marks the beginning of a period in which reinstatement is possible. This reinstatement period lasts as long as up to one day before the actual sale of the property. With foreclosure rates at record high levels country-wide, both the lenders and state governments are attempting to give borrowers every opportunity to bring their loans current. Since October, 2007, there has been a 71% increase in the amount of foreclosures filed. There were 81,312 foreclosures filed nationwide in September of this year alone.</p>

<p>If the loan is not brought current during this reinstatement period, a sale or auction date is then established. The borrower is presented with a Notice of Sale, normally via both first-class and certified mail. The Notice of Sale is also to be posted at the property in question. It is normally taped boldly to the front door. The lender is also required to run an ad in the local newspaper notifying the public of the sale for three weeks in advance of the sale date. State dependent, borrowers are still able to intervene in the foreclosure process. Most states allow the borrower to bring the loan current until the day before the sale or auction.</p>

<p>If the loan is still not brought current and the sale is held, the opening bid is normally set at the amount of the balance of the defaulted loan plus interest accrued and any other fees associated with the sale. Of course, having a skilled foreclosure consultant in your corner goes a long way towards saving your home from foreclosure. They can deal with lenders, court systems and all other involved parties on your behalf and find ways for you to be able to stay in the home that you have worked so hard to acquire. Remember that the initiation of the foreclosure process doesn&rsquo;t necessarily mark the end of your home ownership.</p>

<p>These fears and vocal warnings have impaired the real estate market, stifling housing sales and highlighting foreclosure problems for banks in communities nationwide.</p>
<p>However, despite the bad tales of the real estate market that abound in the news, there are plenty of areas that are growing, improving and seeing positive changes in their housing sector. </p>
<p>Although much of the nation will be either stagnant or continuing to show a decline, these regions are growing, boosted by local economic factors that are shielding the community from a housing bubble catastrophe and giving local investors in these areas something to smile about.</p>
<p>Take McAllen, Texas for example. With a 12 month forecast of 4 percent increase, this area of the country is sitting on strong real estate possibilities. The five year price change for McAllen has been a steady 23.3 percent, giving this region a slow but steady outlook on their housing market. </p>
<p>This Texas region might see the strongest positive return for their housing market, but there are other states that will have multiple cities with positive growth predicted in the next 12 months.</p>
<p>Rochester, New York is already a popular place for families, but with real estate prices seeing a strong 2.7 percent increase in the next year, Rochester is looking even more financially fantastic. With a 20.1 percent rate of increase over the last five years and an admirable 5 percent change in the foreclosure rate, Rochesters real estate market is looking ideal to many investors and families alike. </p>
<p>New York in general seems to be avoiding the real estate crunch as cities like Buffalo and Syracuse are also predicted to see steady 2.4 percent and 2.6 percent increases respectfully in the area. </p>
<p>New Orleans has been predicted to make a strong step forward this year with a 2.2 percent increase in the real estate market. With a 49 percent rate of foreclosure change, it seems this personable city has found its feet after hardship and will start its inevitable climb to being an enviable place to own a home again. </p>
<p>Nearby Baton Rouge has also enjoyed a 1.9 percent housing increase predicted. Combined with their lower 14 percent rate of foreclosure change, Baton Rouge and New Orleans combine to make Louisiana a preferred housing market.</p>
<p>With 75 of the top 100 U.S. cities expected to see falling real estate prices in the next year, these housing areas are anomalies. With record foreclosure numbers and plummeting prices, the fastest growing real estate markets are nothing to sneeze at. </p>
<p>Many real estate experts are predicting the full impact of the real estate bubble burst will not be finished until 2010. Areas like California and Nevada are clinging to their homes, but if you happen to live in McAllen, Texas and other hot markets, rejoice. Your homes are steady throughout the real estate crisis.</p>

<p><b>Answer:</b> You cannot stop a foreclosure sale if the lender does not agree to same.  Attempting a short sale MIGHT benefit the lender, as well as it might benefit you.  However, if the lender involved wants to move forward with foreclosure, the only thing you can do to stop it is to pay in full what you owe.</p>
<p>You can only ask if the lender will postpone a foreclosure if you are working toward a short sale.</p>
