<p><b>Answer:</b> sounds like you have a contract for deed, Something here you are not aware of. I did that on a foreclosure from a bank once, and when it was paid off they then gave me a clean title.  I made a fortune on that property, and still own it. Gives me almost $6500 a month income, with about $1000 a month in taxes...</p>

<p>When you first decide to purchase yourself a home the last thing on your mind is the possibility that something could go wrong for you in the future and make it difficult for you to keep up with your mortgage payments. Before you even realize just how bad things have got those dreaded foreclosure threats could start rolling in.</p>
<p>All home owners should take some time to consider this because nobody knows what could happen in the future that may make paying your bills difficult. Being unable to make your monthly mortgage payments does not mean that you are a bad person or irresponsible and don't care. Sometimes people have accidents or lose their jobs that can cause them a massive financial setback.</p>
<p>Of course nobody ever sets out not to have enough money to pay their bills but this sort of thing can just seem to happen at times. Even people that you would normally think would never have such problems could fall foul to some unforeseen event in their lives. Unfortunately this does happen and if it does happen to you then it doesn't automatically mean that you are going to lose your home. There are still quite a few things that you can do that could save your from having to spend time dealing with foreclosure threats rolling in.</p>
<p>Do not assume that everything is completely under control and no matter what you will always be fine. None of us know what is lurking around the corner for us and if something terrible does happen you could end up having to spend a lot of money leaving you short when it comes to being able to pay your bills. If something bad does happen and you just try to ignore that fact it won't just go away by itself.</p>
<p>Once you have been threatened with foreclosure that threat will stay with you and there might not be a single thing you can do about it. If you manage to stop things before they get that far then you might still be in with a fighting chance to save the home that you worked so hard to buy in the first place.</p>
<p>The best course of action to take is to phone your mortgage company and if you can come to some agreement with them to pay your missed mortgage payments back. They could even give you a set date to pay your arrears back by and if you manage it by then you could even be rewarded with a discount. Pay a visit to your lender's website to find out more about getting hold of a professional that can talk to you about your situation and offer you a solution. Remember that anybody can fall behind on their mortgage payments through no real fault of their own so don't be ashamed about it and start talking to people about it today.</p>

<p><b>Answer:</b> First of all, you can not do a short sale unless the mortgage holder agrees to it.  The VA home loan only covers you if you were to '"default" and go into foreclosure.  Then the VA would cover some of the loss.  If you wish to sell your property, but the net proceeds from the sale won’t pay off your loan and you can’t afford to pay the shortage, the VA may allow you to sell your home without paying the entire amount due. You’ll need to complete a Financial Analysis Form and send the VA a letter requesting a short sale.<br />
They (the VA) would also start taking deductions of any VA comp you are receiving if you are getting disability benefits if they have to actually pay anything to the mortgage company.</p>
<p>Your best bet is to get another veteran to buy the house, is your VA mortgage assumable (some Realtors forget to have that included in the deed.)</p>
<p>The effect of a short sale on a seller's credit report is identical to that of a foreclosure. The ding on credit will show up as a foreclosure in redemption status, which will result in a loss of 200 to 300 points. This means a short sale with a previous FICO of 720 will see it fall from 520 to 420. </p>

<p>If you have been unable to keep making your regular monthly mortgage payments then you may have eventually ended up having to face the foreclosure of your home. In certain cases you may yet be able to fight this and win but in the majority of cases it may simply be too late. If you have recently faced foreclosure or suspect that you might be doing soon then it is worth learning about what to expect next.</p>
<p>One thing that is very likely to happen is that there will be a court hearing that you need to attend. If for whatever reason you do not turn up at this hearing then it is very unlikely that the judge will rule in your favor and give you a chance of still being able to save your home.</p>
<p>Even when you do attend the court hearing and explain your situation to the judge it doesn't guarantee you will have any success. The bottom line is that you broke the agreement to keep current with your mortgage payments over the years. By breaking this agreement foreclosure is an inevitable outcome and the judge may not be able to help you as you would have liked.</p>
<p>Once the court hearing has taken place the next step is that somebody will auction the deeds to your home. At this stage you will also be told that you need to pack everything up and move out of your home. If you refuse to leave then the police could get involved to remove you from the property. You won't be able to do anything about this situation since the property is no longer legally yours.</p>
<p>At this stage you have no more legal rights to the property since they will now have been transferred back to the mortgage company that you took the loan out from. You can usually expect the entire foreclosure proceedings to last for a period of around 3 months. This means that if you are potentially at risk of foreclosure then you need to act before that time runs out.</p>
<p>If you leave things too long and let the proceedings start then it could well be too late and you will not be able to do anything about it. Don't just sit back and let your home be taken from you. Make sure that you stay on top of things at all times to have the best chance of never having to go through this awful experience.</p>

<p><b>Answer:</b> You're still safe. 90 days is the MINIMUM... but I have clients who have been in default for more than a year and they still haven't gone into foreclosure. Some companies are crazier about it than others, and it also depends (I've noticed) on what you owe on the house vs. what it's actually worth right now. IE, if they think they can pretty easily get their investment back by selling it on you, they're more likely to rush the foreclosure proceedings, whereas if you owe $225K on it and right now in this market, it's only worth $150K, they'll let you slide for longer. This isn't always the case but MOST of the time I find this is how it works. This does not, of course, stop them from harrassing the hell out of you and threatening foreclosure. They just want their money, and if sending you scary legal-sounding letters is how they think they'll get it, they're going to do that.</p>

<p><b>Answer:</b> All the VA foreclosre houses are sold "as is", no warranties, and conditions vary with some well cared for. There is a VA Vendee Financing program with both veterans and non veterans eligible and it doesn't matter if you are an owner/ occupier or an investor. Main attraction is NO DOWN PAYMENT. Longterm 15 to 30 years, and I am told they don't use credit scores as a determining factor for approval.. There is no limit to the number of VA homes you can buy with this funding although you are limited to 5 active loans in a 6 month period. Just need to check it out though because it isn't available on all VA homes.</p>

<p>In an age when foreclosures are at a record pace, credit card debt is hitting new highs and personal savings are at an all time low, thousands of America's military are worried about their financial future as they defend our Country.  Many turn to payday lenders with high fees and interest rates to solve their immediate financial needs.</p>
<p>Financial education - a skill young people desperately need - isn't taught in high schools.  So for many military personnel, they enter the military without any knowledge on how to handle their finances.  This can lead to financial problems and military debt since it's the first time many of them have to make financial decisions for themselves.</p>
<p>This lack of financial education is evident in a recent Associated Press report stating that thousands of U.S. troops are being banned from serving overseas because they are deep in debt.  Because of this high level of debt they are considered security risks. On top of that, many unscrupulous payday lenders are taking unfair advantage of many members of the military by charging them fees and interest rates that make it almost impossible for them to get out of the hole.</p>
<p>You can become financially secure in the military with some simple steps.  The tips below will put you on the path to financial freedom.</p>
<p>1. Cut your expenses.  To afford the items you would like to purchase, start by listing everything that you want to buy in the order you want to buy them.  This will help you focus your spending on the things you want the most.</p>
<p>To eliminate needless waist, monitor what you spend money on for a few weeks.  Find out where you spend your money by writing down everything you purchase.  If you're spending four dollars on a cup of coffee during the week that adds up to more that $1,000 a year. You'll find out quickly that those small purchase add up fast.</p>
<p>Develop a military budget by writing down your take home pay and listing your current expenses.  If you're spending more than you make, it's time to cut those expenses or work extra hard to get that promotion.</p>
<p>2. Create a savings plan.  The average American spends more than they earn, so become a money rebel and save money. With a simple investment plan, just by saving $250 a month starting at age 18, you could reach millionaire status by age 40.</p>
<p>Get in the habit of paying yourself first.  Have your bank automatically transfer a portion of your money from a checking account to a savings account or start an allotment directly to your savings account.  Each time you deposit your paycheck, money is automatically transferred into your savings before you have a chance to spend it.  That way you'll have military money set aside for the long-term and available for the things you want to buy now.</p>
<p>Many of you are serving the country overseas now in hostile territory and earning hostile fire and imminent danger pay.  You'll find this is an ideal way to keep more money in your pocket.  Take advantage of the military programs such as TSP (Thrift Savings Plan) and SDP (Savings Deposit Program) that allow you to save military money and earn a higher return when compared with most civilian savings accounts.  By simply setting that military money aside, it will help you to have money in the bank and a way to treat yourself when your return for a job well done.</p>
<p>3. Have the government buy your home.  You can become a homeowner using the benefits the military offers.  VA loans allow you to borrow 100% of the purchase price which means you won't need money for a down payment in most cases. Combine that with BAH (Basic Allowance for Housing) for civilian housing and you can have your mortgage payments paid for.</p>
<p>This is a huge benefit because you purchase a $100,000 home your property could be valued at over $570,000 in 30 years.  The best part is using BAH you could of not even made a payment with your own money.</p>
<p>4. Invest in yourself.  The military offers education benefits through the G.I. Bill, VEAP (Veterans Educational Assistance Program), LRP (Loan Repayment Programs) and TA (Tuition Assistance) may all help you to get a higher education.  Just like in the civilian world the higher education you receive the more likely you are to get promoted and paid more.</p>

<p>You will owe the bank and the IRS WILL tax you.  They will treat it as income in the year that the 1099 issued and taxed at your INCOME rate (not the lower capital gains).</p>

<p>The house is currently under a VA Home Loan which guarantees the lender if I fault they will recover 36,000 k in loses on top of whatever they sell it at a sheriffs sell</p>
<p>Now I know a short sell dings your credit like a foreclosure however my question is if I short sell and the VA covers the rest of the pay off amount (which they will and do I called and asked) will I still take a short sell credit hit because the lender is getting the full paid off amount?</p>
<p>Trust me I have asked the lender and the VA and my real estate agent and I have yet to get a defiant answer

<p>Before you get hung up on concerns that you cannot raise enough finance to invest in one of today&rsquo;s many foreclosures, let&rsquo;s look at the size of the problem.</p>
<p>At each of the three stages of foreclosure the amount of cash you require may differ considerably, and in some cases very little is required. Depending on the property type you envisage, financing choices may be limited; they will certainly vary, as they will depending on your financial status, your creditworthiness, and your ability to manage and recover holding costs. Creativity helps.</p>
<p>Bank owned homes, those owned by the original lender at the end of the foreclosure process, are the easiest to get to grips with. A traditional home mortgage may be by far the easiest way for a home buyer to finance a purchase from the bank. Buying a foreclosed home from either HUD (Housing and Urban Development) or the Veteran&rsquo;s Association (VA) gives you a easier choice (standard mortgage from your own lender as an alternative to FHA and VA loans) and a reasonable length of time to arrange it (30-60days)with probably a 5% deposit or less.</p>
<p>Before the Auction sale, when homes are in pre foreclosure, can present more of a challenge, especially in non judicial process states where foreclosure laws allow a swift process to trustee sale. There may not be enough time to arrange a standard mortgage. There are a range of choices available to the knowledgeable purchaser, some with little actual cash and fresh financing at all. There may be &ldquo;subject to &ldquo; financing available (taking title &ldquo;subject to&rdquo; existing liens), or an opportunity to assume the existing loan (check out the trust deed).There may be no equity in the property and the seller will except just enough cash to assist with moving out.</p>
<p>The Auction or Sheriff&rsquo;s sale presents the greatest challenge. The cash deposit for the winning bid may be high ($5,000 cashier&rsquo;s cheque not unusual) and the time to settle very tight, some states requiring same day settlement. If you are waiting to sell your current home you may be able to arrange a line of credit with your banker before the auction. Investors frequently use Hard Money loans or other unsecured loans if they require a &ldquo;bridge&rdquo;.</p>
<p>For all these stages using your second home or another property, or a large amount of equity built up in your existing home, for a secured loan is often the cheapest alternative.  Make sure you have further capacity to arrange a home improvement loan for the repairs or renovations required. Have you thought of forming an investors&rsquo; pool from among family and friends? These are just some of the usual ways that investors and home buyers use to turn a great opportunity into a sound (and really great) real estate investment.</p>
