Question: In South Florida, can I be evicted from my rental unit if my landlord has not paid his HOA fees?

I live in Fort Lauderdale. My landlord has not paid his HOA fees for 15 months now. The Property Manager wants me, the tenant, to pay the monthly HOA fees or says he will evict me. He claims that Florida Law allows him to do so.

Is this true? If so, can I deduct from my rent the HOA fees and send two checks every month (one to the Property Manager and another to the Landlord) without the landlord approving?

More information:
The property is currently going to foreclosure.
I am now on a month to month lease since my 12 month lease expired and we agreed with the landlord (by email) to continue on a month to month lease.
I have always paid my rent on time.
I do not want to move out since I am getting a really good deal.

Answer: im not sure on the local law but if i was you i would open a escrow account and put your rent there until the landlord gets straightened out, that way if your rent is in the escrow at the time its due and you get a court date a judge can advise what is right, if not and the place goes into foreclosure you can pull all that money back out..........good luck on that one buddy
