My ex husband is in serious arrears for child support and I am expecting a letter from an attorneys office in regards to the foreclosure of our marital home, I opened this thinking it was a document I needed to sign for the mortgage company, but it is in relation to a settlement for wrongful death of his grandfather, on which both he and our children are named as heirs.  I would like to give my attorney/friend of the court this information, but am hoping since he won't change his address I will not be facing any charges for my error...any ideas?

<p><b>Answer:</b> The law only provides for intercepting or causing interception of mail in transit (pre-delivery).  Once the mail has been delivered to it's proper address, there are no laws regulating WHO can open and read said mail</p>

<p><b>Answer:</b> These are all the mortgage walkaway trustee sale states, meaning they are non-judicial foreclosure states.</p>
<p>In those states, generally, when they foreclose on you, they cannot pursue you for their financial losses.</p>
<p>Many, such as California, do in theory allow a lender to choose judicial foreclosure but in those cases the lenders only do so if a borrower has significant other assets. This is the "one action" rule that lets the lender either pursue non-judicial foreclosure, at lower cost and less time, or judicial foreclosure that costs more money and takes more time but lets them go after you for their financial losses.</p>

<p>From what I understand if a trustee sale already took place legally the 2nd lender cannot exercise it's right to recourse. The only way they can have recourse action against you is if they had a judicial foreclosure that went through the court system. </p>
<p>The lender will try to bully you and make you think that they can come after you to squeeze what ever money out of you they can. The only way they can come after your assets is if they have a court hearing and obtain a judgement against you. Even if this were to happen you could claim bankruptcy and have it cleared. </p>
<p>There is a lot of information available about this on the internet. I recommend you do as much research as you can before contacting an attorney. Attorney's are very expensive and may not be necessary in your case. </p>
<p>The first step you should take is finding out if your property went through a judicial or non- judicial foreclosure. If it was non - judicial the 2nd lender has no legal grounds to come after you and they are just trying to scare you into giving them money.</p>

<p>Bankruptcy is a federal court process designed to help consumers and businesses eliminate their debts or repay them under the protection of the bankruptcy court.  Bankruptcy is an option that often has to be considered when an individual cannot pay their debts as they fall due.  </p>
<p>Bankruptcy is not something I recommend any more than I would recommend divorce.  Along with a divorce, bankruptcy is listed in the top 5 life-altering negative events that we can go through, along with severe illness, disability, and loss of a loved one.  In its simplest form, bankruptcy is a legally declared inability or impairment of ability of an individual or organizations to pay their creditors.    </p>
<p>Chapter 7 bankruptcy provides for the discharge, or elimination of, unsecured debts in order to start financial recovery.  Chapter 13 bankruptcy provides a repayment plan for secured debts, such as a home mortgage.  There are pros and cons to each of the consumer bankruptcy options as well as personal financial circumstances that may limit your options.</p>
<p>Because it completely rids you of your unsecured debt, Chapter 7 bankruptcy is the easiest way to come out of debt.  Since all your debt is, in essence, wiped clean in a Chapter 7 filing, people have started abusing it.  In a bankruptcy case under chapter 7, you file a petition asking the court to completely discharge your debts.  Chapter 7 relief is available only once in any eight year period.  Chapter 7 bankruptcy, which is sometimes referred to as total bankruptcy, stays on your credit report for 10 years.  </p>
<p>Chapter 13 bankruptcy, more like a payment plan, stays on your credit report for seven years.  Chapter 13 bankruptcy is the most common type of "reorganization" bankruptcy for consumers: You get to keep all of your property, but you must make monthly payments over three to five years to repay all or some of your debt.  The specific amounts of your repayment are determined by the courts.</p>
<p>Although bankruptcy can help with your financial situation, it does not help in every circumstance.  Debts that are not eligible to be discharged include child support payments, some taxes, and student loans.  Debts that can be discharged include personal loans, credit card debts, and medical bills.</p>
<p>Filing bankruptcy is a very serious move, and you must consider your options in comparison to your financial future.  Filing bankruptcy involves a series of steps that you must be aware of.  Filing bankruptcy is a major decision, with many benefits, including its ability to stop foreclosure, wage garnishment and creditor harassment.  Filing can provide borrowers with clean financial slates either by discharging debt so that the one no longer is liable for its repayment, or by instituting a realistic repayment plan under the discretion of the bankruptcy court.  </p>
<p>Filing for bankruptcy may be one of the most difficult decisions a person can make.  There will always be those who file bankruptcy because of irresponsible financial behavior while others have simply fallen into unfortunate circumstances.  For many who are forced to consider bankruptcy, the actual decision to file is usually the hardest part.  Even with the negative implications of filing bankruptcy, most who have filed will agree that the psychological relief is a huge strain removed from their lives.  Filing for bankruptcy is not the end of the world.</p>
<p>Bankruptcy is not a substitute for financial responsibility.  Bankruptcy is not a quick fix for all credit problems.  Bankruptcy is designed as a legal option to help resolve such a crisis, and act as a financial life preserver for those drowning in debt.  Bankruptcy is the process by which you are legally allowed to get rid of your debt.  Filing bankruptcy should only be used as a last resort effort to help people crawl out of a credit hole and get back on their feet.</p>

The answer is through short sales. </p>
<p>The steps involved in short sales are finding real estate that may be a possibility for a short sale. If you know of a house that you are interested in purchasing, but are not sure if the owners would consider selling their home, you need to do some research. A short sale is one that is done shortly after the lending company sends a default loan notice to the homeowners. You can truly find many great deals and purchasing property with a short sale and turn it around and resell the home for a profit, however, you must know the process. The best way to learn about the entire process is by talking with a real estate agent that has experience with short sales.</p>
<p>The things you need to do once you find a property you are interested in buying with a short sale is to first check out the property. Look at the condition of the property and the home; you do not want to purchase a home that needs major expenses such as a new roof. Once you have expected the property, you should then learn if there are liens on the property, how much is owed on the mortgages, and what financing options might be available. You should contact the lending company and fill out a short sale application. Once all of this is completed, you will have to negotiate with the lending company and the homeowner. This is where a real estate agent and even an attorney will come in handy. </p>
<p>A real estate agent will be able to give you a wealth of information so you will know where to look to learn about the property. You should learn the value of the home, what other homes are worth in the area with the same amenities, and more. You should never fill out an application prior to learning what you are getting into with the home. Negotiating of course will be the hardest part after you have done all the legwork, however, if you have an experienced real estate agent by your side, you will soon have the keys to your new property in your hand and be ready to move in or fix up and put on the market for sale.</p>

What are my chances of staying in my home?  or Should I just cut my losses and move on?  Also, my original Modification fell through because of financial issues on my part.  I didn't follow the plan as agreed but I mailed in one payment and it has never been returned.  I called after I received notice by their attorneys that my work out plan has cancelled.  The rep. takes my financial statement over the phone and sets me up on a payment plan when he shouldn't have...(recently discovered), I mailed a check and was just informed by the mortgage rep., that it's being returned to me because the Bank had already bought my loan.<br />

And believe me, contrarian views do sometimes get huge profits for you, because in such circumstances you will generally face lesser competition from other real estate investors and you can probably get a Colorado real estate piece for much lesser than it actually is worth. </p>
<p>However, we are not saying that Colorado real estate has performed badly. Though I don&rsquo;t remember the exact statistics but Colorado real estate appreciation was about 5-7% only which is much lower to 25% or so for Florida real estate. Again, when we say 5-7% appreciation in Colorado real estate, we are talking about the state in general. So, it&rsquo;s quite possible that there be regions in the state where the real estate appreciation is say 25% and there could be places where there has been no appreciation in real estate. The opportunity is always there, the only thing you need is the art of finding the Golden deal in this Colorado real estate market.  </p>
<p>When assessing Colorado real estate you must take into consideration various factors e.g. you must assess the overall economic indicators and check what effect it can have on Colorado real estate (both in the near term and in the longer term). You don&rsquo;t need to be a financial analyst or a real estate guru for doing this assessment, you just need to keep track of various news items and analysis reports on Colorado real estate. Also keep track of the mortgage rates and laws on tax breaks (as applicable to Colorado real estate). </p>
<p>All these factors influence the trend of real estate anywhere (not in just Colorado). Moreover, you will need to hunt for Colorado real estate opportunities by going to public auctions, foreclosures, teaming up with attorneys for information etc. Again, remember that a not-so-good news about any real estate (be it Colorado real estate or Florida real estate), doesn&rsquo;t mean that real estate investment won&rsquo;t make sense at that place; in fact, it might cut down the number of competitors you have.</p>
<p>So, if you feel that Colorado real estate doesn&rsquo;t rock; you can probably make it rock for you. There always are plenty of opportunities. </p>

<p>The property management company, probably doesn't even know, to be honest, and the landlord is hiding it from everyone so he can keep collecting rent.</p>
<p>I would go ahead and move by the date that they gave you to be out.</p>

<p>As record numbers of homeowners default on their mortgages, questionable practices among lenders are coming to light in courts, leading some legal specialists to contend that companies instigating foreclosures may be taking advantage of imperiled borrowers. </p>
<p>In the last past weeks there have been important events unknown by many homeowners and individuals facing debt collection lawsuits. In a study of foreclosures, Katherine Porter of the University of Iowa found questionable fees on almost half of the loans and discovered that though bankruptcy laws require documentation that a creditor has a claim on the property, 4 out of 10 claims in Ms. Porter&rsquo;s study did not attach such a promissory note. The second event is a court ruling on October 31, 2007 in which a federal judge in Ohio has ruled against a longstanding foreclosure practice, potentially creating an obstacle for lenders trying to reclaim properties from troubled borrowers and raising questions about the legal standing of investors in mortgage securities pools. The third event is another ruling on November 15, 2007 by a federal judge in Ohio who has given lenders 30 days to prove that they own the promissory notes on the properties they intend to seize from troubled homeowners in 27 other cases. In a fourth event according to the New York Times article dated November 28, 2007 and titled "Foreclosures by Lender Investigated," the federal agency monitoring the bankruptcy courts has subpoenaed Countrywide Financial, the nation&rsquo;s largest mortgage lender and loan servicer, to determine whether the company&rsquo;s conduct in two foreclosures in southern Florida represented abuses of the bankruptcy system.</p>
<p>The sighting of a robin does not make a spring, nor do the actions of four judges constitute a trend. Nevertheless, the fact that some courts are taking a harder look at foreclosure practices may foretell a shift in attitudes. In the fourth event involving Countrywide, there is every indication that Countrywide was not alone in the practices at issue. So what makes this story interesting is that it is another example of a subtle shift in power in the judicial system. The plaintiffs have considerably more resources than the mortgage holders (the homeowners), most of whom cannot mount a fight; but judges may be starting to recognize that that power imbalance has led many banks to be sloppy, presumptuous, and at times extortionate, and at least a few jurists are holding their feet to the fire. In this case, the issue was charges Countrywide added to mortgage balance in two bankruptcy filings. When the borrowers objected, Countrywide did not appear at the hearing, leading the judge to remove those costs. Countrywide's failure to respond piqued the interest of the bankruptcy trustee, leading to the investigation. Note the judge ruled against Countrywide's objections to trustee's subpoenas. </p>
<p>The media needs to bring to the public eye that It has long been a common practice for lenders to bring foreclosure proceedings without attaching proof of ownership of the underlying note. Tracking down such documentation may be more challenging because of securitization, the pooling of mortgages into trusts that are subsequently sold to investors.  </p>
<p>The proliferation of legal education books and events such as the ones named above are a waking call for the lending and legal industries; thus making the job of a debt collector attorney more difficult after enjoying decades of easy judgments against individuals who don&rsquo;t know their rights. As Ms Porter&rsquo;s study suggests, if one were to carefully analyze debt collection cases, one would probably discover that many of them lack legal standing due to insufficient proof of claims. The amount of debt collection void judgments in our courthouses is perhaps so vast, that it&rsquo;s almost impossible to estimate how many there are. If every void judgment were vacated with damages, the whole financial and legal system would crumble perhaps representing an unprecedented shift in wealth.</p>

<p><strong>Homeowners Disclosure</strong></p>
<p>&nbsp;With the passage of SB100, Colorado statues now require that every Homeowners Association in the state deliver at least annually, within 90 days following the end of each fiscal year, the following information to all owners upon reasonable notice:</p>
<ul>
<li>&nbsp;The date upon which the&nbsp; fiscal year commences and the operating budget for the current fiscal year. </li>
<li>A list, by unit type of the owner&rsquo;s current assessment, including both regular and special assessments. </li>
<li>Its annual financial statements, the results of any audits, and a list of all Association insurance policies. </li>
<li>The Association&rsquo;s bylaws, articles, and rules and regulations. </li>
<li>All minutes of the executive board and member meetings for the fiscal year preceding the current annual disclosure. </li>
<li>The Association&rsquo;s responsible governance policies </li>
</ul>
<p>This information must be readily available at no cost to the owners at their convenience.&nbsp; Availability means it may be published on a web page as long as an accompanying notice is sent via first class or e-mail; it can be maintained as part of literature table or binder at the Association&rsquo;s place of business; or it may be mailed or personally delivered to the homeowners.&nbsp; The cost of any distribution is to be accounted for as a common expense liability.</p>
<p>&nbsp;<strong>Home Buyer Disclosure by Seller</strong></p>
<p>&nbsp;SB 100 states that, except in the case of a foreclosure sale, the seller of a property in a common-interest community must mail or deliver to the purchaser the most current copies of the following documents:</p>
<ol>
<li>&nbsp;the bylaws and rules on the Association; </li>
<li>the covenants; </li>
<li>the Association&rsquo;s operating budget; </li>
<li>the declaration; </li>
<li>the association&rsquo;s annual income and expenditures statement; </li>
<li>minutes from the most recent annual owner&rsquo;s meeting and any executive board meetings that occurred within the six months immediately preceding the title deadline; and </li>
<li>the Association&rsquo;s balance sheet. </li>
</ol>
<p>This law requires the seller to provide the outlined HOA information to the buyer by title deadline, or, in the case of a for sale by owner, no later than 10 days prior to closing.</p>
<p>&nbsp;The new law states also that &ldquo;written notice of any unsatisfactory provision in any of the documents listed above shall be cause for termination of the contract, if signed by the buyer or on the buyer&rsquo;s behalf and given to the seller on or before the governing documents deadline.&rdquo;&nbsp; Time share units are not included in these requirements.</p>
<p>&nbsp;<strong>HOA Responsibility</strong></p>
<p>&nbsp;The association must use its best efforts to accommodate a seller request for documents.&nbsp; The Association may charge a reasonable fee, not to exceed the Associations actual cost per page, and must make documents available within 5 days of receipt of notice.</p>
<p>&nbsp;<strong>Disclosure Documents/ Receipt of Documents</strong></p>
<p>&nbsp;Additionally, the seller must provide the buyer with a disclosure statement in bold-faced type.&nbsp; It is the seller&rsquo;s responsibility to obtain from the purchaser a signed acknowledgement of receipt of this information and disclosure statement at closing. This signed form must also be sent to the HOA in a reasonable time frame.</p>

Accomplishing this requires a dependable regular income, and you won&rsquo;t be able to do this if you are frequently absent from work. Not only will you be burdened with rising medical bills, you may also lag behind your mortgage payments, which may eventually lead to <strong>foreclosure</strong>.</p>
<p>Obviously, absence makes the pocket shallower; it can also take away your home. One thing you can do to prevent this from happening is make sure that you don&rsquo;t get sick.</p>
<p>Similarly, foreclosures have the same effect on one&rsquo;s health. Overdue mortgage payments and foreclosure notices can stress out a person to the point of getting sick. Then, your work suffers, and eventually, your home.</p>
<p><strong>Homelessness</strong> is the next phase of this vicious cycle. Homeless people are exposed to the elements, germs, bacteria, and viruses, making them more prone to illness and infection. Without proper medical attention, health conditions can worsen. Who knows what could happen next?</p>
<p>The government already has a legislation that will provide various housing assistance programs to different people. One of them is the creation of a national <strong>Housing Trust Fund</strong> which is designed to provide housing for those in need.</p>
<p>But if we really want to deal with this problem head-on, initiatives must start in the neighborhoods. We can&rsquo;t just solely depend on the government to do all the dirty work. Communities also have a duty to look after the needs of their residents.</p>
<p>Take the <em>Mental Health Board of St. Louis</em> in Missouri as an example. This institution offer services like homeless outreach and housing stabilization programs that make sure that the homeless and those with mental health disorders have a house where they can be safe. Their programs also ensure that these people are placed in an environment where they can have access to supportive services.</p>
<p>The <em>National Health Care for the Homeless Council</em> located in Nashville, Tennessee, fights to put a stop to foreclosure and make access to health care available to everyone. If you are homeless and looking for shelters, you can seek help from the <em>National Coalition for the Homeless</em> online directory of<em> Local Homeless Service Organizations</em>. Shelters and homeless service providers are listed by state. You can also use the Directory of <em>Homeless &amp; Housing Advocacy Coalitions</em> for further resources. The council also provides relevant information on healthcare services through their <em>Health Care for the Homeless</em> providers in each state.</p>

<p><strong>In Michigan a bank can choose either judicial or in-court foreclosure or non-judicial or out of court foreclosures.&nbsp; As with all states where both methods of foreclosure maybe used, the determining factor as to which process the bank will choose is whether or not the deed of trust or mortgage contains a power of sale clause. It is the power of sale clause that allows the bank to forgo the time and expenses of filing a lawsuit against the homeowner who is having trouble making his payments, to begin the foreclosure process.&nbsp; Since it is in the banks best interest to spend as little as possible on the process and move it along as quickly as possible, the bank will always choose to use non-judicial foreclosure when it can.</strong></p>
<p><strong>The only time a judicial foreclosure will be used is when there is no power of sale clause in the deed of trust or mortgage.&nbsp; When no power of sale clause exists, judicial foreclosure is the banks only option.</strong></p>
<p><strong>To follow this course of action, the bank files a lawsuit against the home owner asking the court to find the homeowner officially in default.&nbsp; When this has been obtained the judge/court will tabulate the amount that the home owner owes and give him or her a short time to come up with that amount of money.&nbsp; If during this allotted time the homeowner is unable to pay this money, then the home will be scheduled for sale.&nbsp; The court actually must issue the notice of sale.&nbsp; Following this action, the process moving forward, the sale date is followed the same way, whether it is a judicial or a non-judicial foreclosure.</strong></p>
<p><strong>When a power of sale clause is very specific in the details of how the sale is to be conducted, those instructions must be followed.&nbsp; In such a case the date-time and terms of the sale will be laid out in the deed of trust or mortgage.&nbsp; Such detailed, instructions are not.</strong></p>
<p><strong>Usually included in a power of sale clause in all instances where those details are not included in the power of sale clause, the 1st step is that a notice of sale must be advertised once a week for four weeks.&nbsp; </strong></p>

<p><strong>This ad must be run in a newspaper with circulation in the county where the house is located.&nbsp; A copy of the notice of sale must be physically posted on the home in question as well.&nbsp; This posting of the notice must be placed on the home following the first day the ad is run in the newspaper. </strong></p>
<p><strong>This notice of sale must include the names of the home owner and the bank.&nbsp; It must contain a description of the property and the date, place, time and terms of the auction.</strong></p>
<p><strong>The auction can either be conducted by the bank&rsquo;s Lawyer, referred to in most cases as by trustee or the courts sheriff.&nbsp; The sale will always be held between nine are and four pm on the date listed in the notice of sale.&nbsp; The home will be awarded to the person making the highest bid at the auction.</strong></p>
<p><strong>Postponement of the sale can be arranged at the discretion of the bank.&nbsp; Postponements of less than one week will only need to be announced by posting the new sale was originally to be held.</strong></p>
<p><strong>Postponements longer than one week must be advertised in exactly the same manner as the originally scheduled sale was done.</strong></p>
<p><strong>In Michigan, when a judicial foreclosure has been used, the former home owner is given one year right of redemption following the sale of the home.&nbsp; This means that for one year following the sale of the home the person who lost the home at the sale can regain ownership of the home.&nbsp;&nbsp; They may do this by paying the amount of the winning bid at auction, plus interest.</strong></p>
