The state of Texas is one of the states that were hit hardest by the mortgage crisis that the United States is currently facing.  Though the rate of Texas bank foreclosures is pegged right now at only 1.6%, the situation is that there are an estimated 10,000 Texas bank foreclosures going on every month.  This figure includes Houston bank foreclosures.  This means that for every 809 households in Texas, one is facing some sort of Texas bank foreclosures procedure.

Texas has one of the toughest procedures for foreclosure in the United Sates.  The whole process, which also applies to Houston bank foreclosures, can take only a little over a year to complete.  In some cases, the entire process takes even less than a year.  The process for foreclosures in Texas starts with the default, in which the lender would notify the borrower in writing that he or she needs to be updated with the mortgage payments.  The period for the default can last anywhere between a month and a year, depending on the decision of the lender.

If the borrower fails to make his or her mortgage payments updated during the default period, then the process for Texas bank foreclosures calls for the start of the acceleration period.  The acceleration period is a 30-day period wherein the lender would make a demand for the borrower to pay the amount owed in full plus interest.  This can probably be the toughest part of the borrower’s life if he or she really does not have the money to settle the mortgage payments.  The borrower would need to pay up or sell the house in order to avoid having to face Texas bank foreclosures proceedings.

Once the 30-day acceleration period ends, the foreclosure period begins.  In Texas, the foreclosure is only 21 days.  At this point, the borrower would have to vacate the premises of the property to avoid being literally thrown out on the curb.  That is really done in Texas; if the borrower does not leave the property at the end of the foreclosure period, the authorities would come to put his or her belongings out on the street and change the locks on the property.  Most borrowers who defaulted on their mortgage payments would rather leave than be subjected to this part of the proceedings for Texas or Houston bank foreclosures.

At this period, a notice of sale or auction would be put up by the lender or the lender’s trustee at the county courthouse 21 days before the date of the Houston bank foreclosure sale.  The same notice would be mailed to the borrower at the same time.  If the house is put up for auction, the lender or the trustee will award the ownership of the house to the highest bidder, with the title stripped of the junior liens on the property.  The winning bidder, however, will have to deal with any senior liens that the property carries.  If the winning bid happens to be more than what the borrower originally owed the lender, then the difference would be used to cover the junior liens on the property.

Redemption rights in foreclosure actually only come after the homeowner's property is lost through judicial sale or foreclosure. The owner can redeem by paying the lender the outstanding principal and interest due, plus the lender's costs in foreclosure. Once the home has been lost, some states allow the homeowner the right to "reclaim" his home for varying periods.

Because of the power the banks have for foreclosing, some states decided that that homeowners should likewise have the right to reclaim their home if their personal circumstances turnaround within a given time period. The homeowner will have to petition the court for a hearing to get his home back and show "proof of funds" that he is able to repurchase his home for what is owed plus all the associated costs of the foreclosure.

Proof of funds can either be cash in the bank or a pre-approved letter from another lender that is willing to fund his purchase. The new lender does not have to be a bank, but can be a "hard money lender" who will charge the homeowner a much higher interest rate and closing points and will only carry the loan for year or so.

These hard money lenders are sometimes called "predatory lenders". The amount they will lend is based on the "quick sale" value of the property. That gives them an equity cushion in case they are forced to again foreclosure upon the property to recoup their loan money.

The homeowner who lives in one of the states that has long redemption periods, can solicit local hard money lenders or real estate investors to exercise his redemptive right if there is equity in the home that can be retrieved by fixing the property and selling it in the retail market.

These are called Equity Agreements and are common in the real estate business. Equity Agreements stipulate who gets how much of the proceeds from the sale, who pays what expenses and who will be dong the work. Remember, if it isn't in writing in the Agreement, it isn't going to happen. If you have a question, ask an attorney before you sign anything.

Here are the states that have no redemption period: Arizona, Connecticut, Delaware, Hawaii, Illinois, Iowa, Louisiana, Massachusetts, Mississippi, Montana, New Hampshire, New York, Oklahoma, Pennsylvania, South Carolina, and Texas. While these sates have no redemption privileges, it is possible to bring legal action against the bank with regard to deficiencies in the foreclosure proceeding or mortgage irregularities. This is seldom worth the effort.

States that have one year redemptive rights include: Alabama, Idaho (either 6 or 12 months), Kansas, Kentucky, Maine, North Dakota (6 or 12 months), and Wisconsin (possibly to 12 months).

The other states vary greatly because of specific terms in the mortgage or deed of trust contracts but range from 10 days to 240 days. It is imperative that become familiar with your local foreclosure laws because they vary greatly from state to state, and the sale or auction practices vary from county to county.

The housing market in Seattle, Washington is still dominated by REO properties for sale. But the level of foreclosures in the area is much lower compared with other housing markets in the country. Thus, home sales could sometime be slow and prices showed gains because bargain hunters find a much lower supply of cheap REO properties for sale in the region.

In April, the region’s median home sale price increased slightly, but declined by 11 percent from the previous year and 16 percent from its 2007 peak.

Last May, the metropolitan statistical areas of Seattle-Tacoma-Bellevue posted 3,142 escrows for new, existing and resale homes and condominiums. The figures cover counties of Snohomish, Pierce and King.

MDA DataQuick reported that home sales also increased by 13.5 percent compared with April figures, but declined by 21.7 percent from a year ago. Furthermore, the sales total last month was the lowest for the same period since 1994. Year-to-year sales dropped consecutively for 36 months while sales of new homes posted a record low last month.

Meanwhile, REO property for sale in the region drives affordability and home sales. But unlike other housing markets, foreclosure is not so rampant that it may result to a drastic drop in home prices.

Last month, 19.2 percent of resold properties in Seattle have been foreclosed for a year, an increase of 5.9 percent compared a year ago and down from a high of 21.8 percent last February. On the other hand, foreclosure resales accounted for more than 50 percent of all reselling activity in Las Vegas, Nevada, Phoenix in Arizona and many areas in California.

The combined median price for new, existing and foreclosure resale homes and condominiums was $308,000, representing a 1 percent gain from April’s $305,000 and a 10.7 percent drop from the previous year.

Last May’s median home price was the highest recorded for any month, except December which was $318,000. But the December figures were down by 15.7 percent than the region’s median peak price of $365,000 in June 2007.

Industry experts said that the median home sale price’s slight increase last month from April was the result of low supply of foreclosure resales and the mild gain in sales of properties above $300,000.

Last month, the median price for a single-family detach REO property for sale was $307,000, representing a decline of 13.5 percent from the previous year.

Question: Is this true about foreclosures in AZ?

A friend of mine is upside down in his house. He is thinking about foreclosures and after helping for hours researching information we came across this in Arizona law:

A lender may not bring a deficiency suit against a person who lost a property that is 2.5 acres or less at a foreclosure, provided the property was a single one-family or a single two-family dwelling. This is so even if the high bid at foreclosure was less that the balance due on the loan.

Does this mean that anyone in Arizona who is caught up in the housing craze can just walk away from there homes and not worry about nothing except for a mark on their credit for 7 years. If so then everyone in a bind should do it because it will take longer than 7 years to pay off the cars and TV's they bought with the 2nd deed of trust anyway.

Answer: Arizona is a nondeficiency judgement state, which does mean a lender cannot go after additional assets of a home owner in the case of a foreclosure.

However, if he is foreclosed on, the entire foregiven mortgage amount is considered income by the IRS. So at the close of the foreclosure your friend (and the IRS) will receive a 1099 showing the forgiven debt. Your friend will be resonsible for paying income taxes for the mortgage amount.

I had it happen to me in Arizona in 1993. I was foreclosed on, then got smacked with a massive tax bill the next year and was forced into bankruptcy. That law still stands, although I think it is truly the stupidest tax law we have as a country.

However, a foreclosure does not completely go away after 7 years. Almost all lenders have a question on every lending application:

"Have you ever had a foreclosure?"

Note, it doesn't say within the last 7 years, but ever. In fact, many lenders will look at a potential borrower if it has been more than a few years since a foreclosure - often more than 2-3 years, but anyone who has had one is always under much more scrutiny, will almost always pay more interest than anyone who has never had a foreclosure. And, yes, before anyone comments, if you just say "No, I never had a foreclosure" and are caught, that is loan fraud, a federal crime worth up to a $500,000 fine and 10 years Federal Jail.

Your friend is much better off working out a short sale or doing a deed-in-lieu of foreclosure than doing a full foreclosure. I did a foreclosure in Arizona and I still regret having done it.

I notice there are always many houses available for sale that have been foreclosed. The houses in many cases are practically being given away at cheap prices. I have seen them as low as $9,000 in some areas. Are foreclosed houses good buys for those really wanting to purchase a home. But, aren't the richest people in america?

Answer: A really cheap foreclosed home is probably not in liveable condition and while you may be able to pick one up for little money it would probably take a lot of money to make it livable again.

Be careful and make sure that you have a chance to inspect the property and also have a professional home inspector give you a report about the problems that need to be fixed. This way you will get an idea of how many thousands of dollars it would take to get the house back in shape.

I would rather check into Real Estate Owned (REO) properties.
You will have plenty of time to inspect the property and can be sure that there are no "surprises" waiting like back taxes that are due or second and third liens that have to be paid off.

Question: In the even of foreclosure, will my credit be effected if the home is only in my husbands name?

If we need to foreclose on our home will my credit be effected if the home is only in my husbands name and not in my name at all? I never signed my name to one paper and the house is not in my name at all. I actually had to sign a paper stating that the house was not in my name at all and have it noterized. They either don’t know what to do with a no-equity deal or they are unwilling to put forth the effort necessary to make the deal work. In situations like this, we SHORT SALE the mortgage.

“What is a short sale?”

You ask. To short sale a mortgage means getting the bank to accept less than is what is owed as payment in full. There are several steps that will ensure your success when short selling mortgages.

First of all, you must have the homeowner under control. Many investors are under the misconception that they can buy the property directly from the bank while it is in the foreclosure process. Not true! The bank does not own the property until the moment of the courthouse sale. You can buy the mortgage and finish the foreclosure process, but you cannot buy the property. You’ll have to work hand-in-hand with the homeowner if you plan to short sale mortgages.

Here is how it works: A homeowner calls you and talls you he or she is in foreclosure; owes $350,000 on his property; it’s worth $290,000 and he is 3 months in arrears. He wants to move on with his life but can’t sell his house because he owes what it is worth. Here is where you come to the rescue. You meet with the homeowner and have him sign an “Authorization to Release” form (this gives the bank permission to speak with you about the account) and a sales contract for the amount you are willing to pay for his property. In this scenario we are going to offer $190,000.

Next, you call the bank and ask for the Loss Mitigation Department. This is the department that handles properties that are in foreclosure. Tell the person handling the account that you are trying to help Mr. Smith with his foreclosure and you are willing to buy the property from him. However, due to its poor condition you are only willing to pay $190,000 as payment in full. Fax the sales contract for $190,000; comps in the area; an extensive list of repairs that are needed to bring the property up to marketable condition; a net sheet (a title company will help you with this); and some really bad pictures. The bank will then review the information and make a decision. Let’s say they counter at $230,000; you counter again at $200,000; they accept! It’s that simple! We short sale many, many mortgages every year. Banks are not in the business of owning properties. They would rather short sale a mortgage than go to the courthouse steps.

I like to share an incredible deal which I recently came across in Arizona, the reason I share this particular deal vs. the dozens of others I do per month, is because this was the fastest short sale and flip I have ever done. I came across a property valued at $200,000 in a distress situation. The property had a mortgage of approximately $238,000 and was in need of several thousand dollars of repairs. Based on the fact that the current owner owed more than what the property was worth I did what any prudent investor would do, I immediately started a short sale proposal. I contacted the bank and began the process. My first offer was $120,000. The bank laughed and told me to make a higher offer. After several phone calls, the bank agreed to accept $135,000 as payment in full. That is a $103,000 short sale! I Agreed and then wholesaled the property to another investor for $168,000 and made a smooth $33,000 in less than 8 weeks!!!

This is a typical case where having a firm grasp on creative real estate enabled mei to turn a “nothing deal” into a “something deal” just by picking up the phone. I made money (and a lot of it) on a deal most investors would have passed by. The bank was happy with the short sale,

So… the next time you get a call from a distressed homeowner with no equity, what will you do? Walk away or make a few simple calls and turn your time into cash? I certainly hope you will make the small effort it takes to short sale the mortgage. It is such an easy way to make money in an industry where great deals are tough to come by. When you short sale a mortgage, not only are you helping yourself; you are helping a very distressed homeowner and giving them the chance to start over. One can never go wrong when win/win is the solution.
