Question: help with understanding bank owned foreclosures?

If a bank owns a house that is worth 200,000 lets say. And lets also say that all that is owed on the house is 100,000. As a buyer, if I put in a bid of 115,000(to cover closing costs) is the bank going to accept this offer. I heard a rumor that all the bank wants to do is collect the money owed on the house and whatever they recieve after that, they give to the original owners. Is this true? Help clarify some of this for me. I am in the state of Texas if that makes a difference. Thanks.
Ya but lets say that whatever I am offering is covering all of the banks cost, if this is so, then what's to say that the bank won't sell me the house with a low-ball price?

I don't know the redemption period in Texas, but in many states, you can squat in your house for a year before getting kicked out, all the while interest is accruing.

So it's never quite that simple. And beware of any additional liens, foreclosures sometimes have them.

And yes, in most cases, after the bank has gotten every single penny of their own money back, they have to give the rest to the prior owner. So they might very well not care how much that is, but they do work within a framework of attempting to get the maximum value for their homes, based on their estimates of what the homes true value is.

And they also have to weigh their risks of having another 2 months go by before they get another qualified offer, while their carrying costs and attorney review fees etc... keep rising. So they're always looking to take the first fair and reasonable qualified offer that they can get.

Hundreds of thousands of repossession property units are hidden from investors, home buyers and analysts, according to Steven Hagenbuckle, top executive of private equity fund Terracap Partners.

Hagenbuckle said that these hidden foreclosure properties are real estate-owned and are due to be released to the market in the next several months.

From May 2008 to May this year, there were 3,734,711 foreclosure actions filed, according to Hagenbuckle. He said out of these filings, about 985,571 are real estate-owned, which is nearly 27 percent of the total foreclosure filings. Hagenbuckle claims that these REO repossession property units have not been released to the public, while the rest of the foreclosures have been offered for sale through foreclosure listings.

Most banks bundle repossession property units into packages of about 50 units and then offer them for bidding through private channels, according to Hagenbuckle. Typically, these foreclosure properties are sold at a discount of 40 to 60 percent to investors.

But sometimes, according to Hagenbuckle, banks manage the sale of their repossession property units in various areas through foreclosure listings or multiple listing services in these areas. The banks use these foreclosure listings for properties that do not get attention from private investors.

Additionally, Hagenbuckle said, the private investors who acquired foreclosure properties from the banks typically release these units to the market 3 to 6 months after their purchase at much higher prices.

Hagenbuckle explained that large numbers of repossession property units were hidden and are due to flood the housing market in the coming months because the foreclosure moratoriums imposed by state governments, various government agencies and financial institutions distorted the listing schedules of the investors.

For instance, Hagenbuckle said, Florida imposed a moratorium that lasted until the middle of January while Fannie Mae and Freddie Mac lifted their moratoriums at the end of March. California started another three-month moratorium that took effect on June 15.

Several of the country’s biggest financial institutions also imposed and then later lifted foreclosure moratoriums, such as Bank of America, Wells Fargo, JPMorgan Chase and Citigroup.

All in all, if these foreclosure properties are released and added to the market which is already full of repossession property inventories, home prices will fall down further. Based on the Standard & Poor’s/Case-Shiller 20-City Home Price Index, home prices declined in April by more than 18 percent on a year-over- year basis.

The storm of real estate foreclosures will worsen reaching new record highs in 2008 surpassing the Great Depression, according to a new report by Housing Predictor, which forecasts housing markets in all 50 U.S. states.

Foreclosures have already hit record highs in the majority of the U.S. and they are beginning to impact the overall economy. But the epidemic of foreclosures will also provide the best buyers real estate market in years for many new home buyers and investors.

The CEO of RealtyStore.com says the epidemic is developing into “the perfect storm” of foreclosure activity. “With 2 million subprime loans resetting over the next 12 months, higher gas prices and with banks tightening mortgage standards the foreclosure activity sweeping across the nation will grow,” said Tim Chin, Realty Store President and CEO.

The tightening of lending standards will further depress home sales, creating a wave of

foreclosures that will bring down home prices as bank owned properties generate downward pressure on prices. As a result of higher gas prices consumers are spending more on gas and less on other products, slowing consumer spending. Housing Predictor analysts forecast the national economy is moving into a recession, which will become apparent at the latest in the third quarter of 2008.

In Detroit, where real estate foreclosures are the highest in the nation the U.S. Conference of Mayors held a meeting of big city mayors to deal with the crisis. It included talks on the state of the mortgage industry and ways home owners can avoid foreclosure. Mayors are hopeful to find strategies to keep foreclosed properties from dragging the quality of life down in their communities.

Detroit Mayor Kwame Kilpatrick is hosting the forum. “We’re talking about finding a local solution to a national problem, “ said Kilpatrick, who added that mayors will not be considering legislation to solve the national epidemic. “We’ll start with conversation here.”

Cities hardest hit by foreclosures in Arizona, California, Florida, Indiana, Michigan, Nevada and Ohio will be a focus of the conference.

Housing Predictor forecast early this year that 3 million foreclosures will occur through 2009. More than one million homes have already been foreclosed, most of which have been subprime mortgages. But defaulting mortgages are also growing in exotic conventional loans, also known as Alternative A mortgages.

“Sighâ€. Unfortunately, that’s a fantasy and reality is what we have to deal with.

Why are the big banks so difficult to deal with? Why don’t they seem to understand that they lose more money when they foreclose on properties than when they negotiate a loan modification or short sale?

Perhaps it’s we who really don’t understand where the money is made.

Do you really think that banks are able to have 24/7 customer service for credit cards and other loans, but can’t seem to come anywhere near that for loan mods & short sales? Do you really think, given technology that can track a package mailed to Timbuktu online, that faxes and emails really get lost? How hard is it really to train someone to do a loan modification or short sale?

Consider this - Chase bought WAMU in September of 2008 for all of $1.9 billion dollars. For that they got a bank with almost $310 billion in assets, $188 billion of it bank deposits. Now Chase will tell you that the deal wasn’t that great as they had to absorb a hemorrhaging mortgage portfolio of $176 billion that they immediately wrote down by $31 billion. That’s true, but hides what really is going on.

If you ignore all the other debt and assets, Chase got $176 billion in home loans for $1.9 billion. That’s just over 1% of face value. Assuming an average loan balance of around $300,000, that’s almost 600,000 mortgages and corresponding homes. That means they paid an average of only $3,000 for each of those loans. Even if they foreclose on the ENTIRE portfolio, do you think they can make money by reselling houses they got for $3,000 each?

In January of 2008, Bank of America paid $4 billion for Countrywide. Countrywide serviced about 9 million loans valued at $1.5 trillion dollars. Do you really want me to run the numbers on this deal?

The failed IndyMac Bank was sold earlier this year to a group including George Soros and Michael Dell, under the name OneWest. Sheila Bair, the head of the FDIC, had made IndyMac her personal guinea pig project for testing out aggressive loan modifications to slow foreclosures. OneWest issued a press release at the sale, stating they would continue to pursue the FDIC’s loan modification and short sale strategy. How long do you think that lasted? Try calling IndyMac now for either and see how far you get. Better yet, call Dell computers and ask them how you can customize your loan modification online just like you can order a computer.

So what incentive do these banks really have to approve loan modifications and short sales?

Who created this financial bonanza for Wall Street? The financial geniuses in Washington D.C. They could have put in place restrictions and requirements tied to the purchase of these banks, but they didn’t. Is this something they could have mistakenly overlooked? Not likely. So, this means our wonderful administration in Washington is allowing the banks to make money off the tax payers that bailed them out.

Nice. Now what are you going to do about it? Probably nothing, as it’s easier to just tune into the latest reality show on TV.

Question: ohio foreclosure? please help?

can someone please give me a timeline? our last payment was due on march 15th.our mortgage is with chase bank.my husband lost his job and theres no way we can pay for this house.i just want to know what is the timeline? how long will it be before the sherriff shows up and throws our stuff outside? ive heard anywhere from 90 days to 8months.does that mean 90 days after they file foreclosure or 90 days after our last payment was due??? im really freaking out here,we have 3 kids and no options.i need a definitive answer,please.

Answer: Basically you have about 8 months from the issuance of the NOD (notice of default). This is the suit that is filed with your local court to begin the foreclosure process. Once they file that you have about 8 months.

They will typically issue the NOD 90 days after your first missed payment. Please note that there is no redemption period in Ohio so if the property goes to auction it is gone.

Also, that even of they have issued the NOD and anywhere after up until the day before the sale date, the Mortgage Company will still be willing to negotiate with you to stop the foreclosure. You have to show them you can afford the property and they will be willing to work something out with you. Chase is very good about accepting a Loan Modification where they will put most of the past due amount at the end of the loan.

 Multi-million dollar flips in the news;   Search Nationwide Foreclosure Listings   An Italian real estate mogul is hoping to pull off one of the biggest property flips in New York history. The state of Texas is one of the states that were hit hardest by the mortgage crisis that the United States is currently facing.  Though the rate of Texas bank foreclosures is pegged right now at only 1.6%, the situation is that there are an estimated 10,000 Texas bank foreclosures going on every month.  This figure includes Houston bank foreclosures.  This means that for every 809 households in Texas, one is facing some sort of Texas bank foreclosures procedure.

Texas has one of the toughest procedures for foreclosure in the United Sates.  The whole process, which also applies to Houston bank foreclosures, can take only a little over a year to complete.  In some cases, the entire process takes even less than a year.  The process for foreclosures in Texas starts with the default, in which the lender would notify the borrower in writing that he or she needs to be updated with the mortgage payments.  The period for the default can last anywhere between a month and a year, depending on the decision of the lender.

If the borrower fails to make his or her mortgage payments updated during the default period, then the process for Texas bank foreclosures calls for the start of the acceleration period.  The acceleration period is a 30-day period wherein the lender would make a demand for the borrower to pay the amount owed in full plus interest.  This can probably be the toughest part of the borrower’s life if he or she really does not have the money to settle the mortgage payments.  The borrower would need to pay up or sell the house in order to avoid having to face Texas bank foreclosures proceedings.

Once the 30-day acceleration period ends, the foreclosure period begins.  In Texas, the foreclosure is only 21 days.  At this point, the borrower would have to vacate the premises of the property to avoid being literally thrown out on the curb.  That is really done in Texas; if the borrower does not leave the property at the end of the foreclosure period, the authorities would come to put his or her belongings out on the street and change the locks on the property.  Most borrowers who defaulted on their mortgage payments would rather leave than be subjected to this part of the proceedings for Texas or Houston bank foreclosures.

At this period, a notice of sale or auction would be put up by the lender or the lender’s trustee at the county courthouse 21 days before the date of the Houston bank foreclosure sale.  The same notice would be mailed to the borrower at the same time.  If the house is put up for auction, the lender or the trustee will award the ownership of the house to the highest bidder, with the title stripped of the junior liens on the property.  The winning bidder, however, will have to deal with any senior liens that the property carries.  If the winning bid happens to be more than what the borrower originally owed the lender, then the difference would be used to cover the junior liens on the property.

Question: Why haven't adjustable rate mortgages been outlawed?

I have called my senators 100's of times over the past 5 demanding that these adjustable rate mortgages be outlawed and they haven't done anything. In addition, I want 100% loan to value ratio loans outlawed. We can thank the states of California, Michigan, Illinois, and Ohio for the current over-hyped foreclosure situation.

Stupid headlines like Foreclosures up 68% are misleading as hell. Less than 1% of all the home loans nationwide are even in foreclosure.

The U.S. had one foreclosure filing for every 617 households in November, RealtyTrac said. That is meaningless. During the attack on the United States oil industry between 1984 and 1992 one in five homes were posted for foreclosure in Texas and no one cared. Banks didn't do anything to help.

I could care less how much homes have declined in California or anywhere else for that matter. Home values go up and down all the time. Rent homes and people who do not maintain they yards affect values more than foreclosures

Question: We are trying to buy a bank owned foreclosed home?

We are interested in purchasing a home in Florida. It is a bank owned foreclosure and the asking price is $89,900. We put in an offer for $106,000 with seller paying $6,000 in closing cost so the bank will actually make $10,100 more than they were asking. As most people searching for homes now realize this is a very competitive market. They want the highest bid but we really want this house. It's the perfect size age, and it has a heated in ground pool! Has anyone had this happen to them? What was the ending result?

FYI all bids needed to be in by noon today (2 hours ago) and we put ours in at 10:30 this morning. The bank (owner of home) called my realtor at 11:30 and asked if that is the highest bid and we confirmed. So I am guessing that is a good sign if they are asking. Please HELP!!! I am already getting anxious and it's been a couple of hours LOL

There appear to be a few Law Offices in California that specialize in negotiating with lenders and for much less than the cost of a refinance. A lawyer can work miracles especially if they find RESPA or TILA violations to use for leverage. They know how to talk their language and get the lender to the bargaining table. You hire an Attorney and next thing you know those people in the Loss Mitigation and legal department are your best friend. Sad but true!

Question: Why has the media stopped covering the economy? Is the economy some how fixed now that swine flu is out?

With the "outbreak" of swine flu, is the economy suddenly now not issue #1? Has the the swine flu somehow undone all the deficit spending and foreclosures in America? Has it somehow restored the banks confidence in the public?

It's a little pathetic how a flu that has killed less than a 1,000 people thus far is suddenly dominating the headlines, when the plain ol' regular flu kills approximately 500,000 people a year.

What new, sensational story will the media run with next week to forget they ever mentioned the swine flu? When will the economy be crappy enough to be worth covering?
