<p>Hello -- I live in DC and am looking for a foreclosed property as the only way of being able to afford a home here. However, every website I go to seems to be a commercial venture: once the site is entered and a property found, registration and / or payment is usually required. Bank owners of foreclosed properties will be keen to sell these without barriers to viewing, so these register sites are obviously just skims and scams -- how do I find a place that lists such properties for sale?

<p><b>Answer:</b> Try oreolist.com they are not an RE agent site. All it does is provide a list of links to banks that have their foreclosed homes for sale on their web site. There is no signing up or anything.

Ok, I am having a hard time finding the answer I'm looking for, hope someone can help. We live in Minnesota<br />
My hubby and I do not want to foreclose on our home, nor do we want to do a short sale, as I hear a short sale is every bit as bad if not worse than bankruptcy. We have a second mortgage as well. If we file bankruptcy and put the house in with that, approx how long will we be able to stay in the home before we get kicked out, and how do they do it? I don't want them to come and slap a yellow sticker on the window like they would in a foreclosure and make it obvious to the neighborhood that we defaulted on our mortgage. Does anyone know how long we will be able to stay, and what will happen to the house when we are forced to leave?

<p><b>Answer:</b> Check with your bankruptcy attorney. If you aren't or can't resume payments on it I suggest to leave as quick as possible, allowing the house to be put on the market sooner and hopefully sell sooner. Each day that goes by adds more interest to the loans you have on it &#038; increases the money you won't or can't pay.</p>

<p><b>Answer:</b> You can afford to get a FREE consult from lawyers. Most offer your initial meeting for free. Also you CAN go to your family court (county courthouse) and apply for child support. The sooner you do that the better. Once the court gets your request, you can back date any owed support (from the date you filed, unfortunately not for time prior to that...you can try to sue for that later though). You should contact his commander. I know you said you don't have that information but you DO have his social security number, that should be all you need, as his wife.<br />
 Just call the JAG office or Post Advocate General and let them know you are trying to contact your spouse's commander in order to persue child support and allimoney. (JAG will not be able to represent you in a divorce but as a military dependant you can seek FREE legal advice from them)<br />
Also, do you have any power of attorneys? Most military spouses have legal say over their military spouse's money. If so, its possible YOU can close his bank account or change PIN numbers, etc. The housing allowance unfortunately is his (but legally your house is marital property) You do have some rights to the value of the house and any vehicles and other things purchased while married (or that you and the kids shared).<br />
Please start making phone calls (look up numbers to military bases and offices on them online). Also, please go file for child support. (the longer you wait to do this, the less you will be entitled to backdate). Make some appointments for free consultations. Alot of lawyers will also work out payment arrangements. GOOD LUCK<br />
PS if he does send you divorce papers, they are probably NOT in you and your children's best intrest DONT SIGN THEM without a lawyer looking at them for you (JAG WILL look at them and explain them free of charge)</p>

<p><b>Answer:</b> Some tenants sign low-price sweetheart deals with the old landlord. But all leases are void if the bank takes possession. If you bought it from the bank you start them all with a fresh slate. If you bought it from the old owner just before the bank got it you are stuck.</p>

<p>The streets are littered with &ldquo;For Lease&rdquo; signs, the unemployment rate is the highest it&rsquo;s been in decades, and vacancy rates are increasing. As a result of these factors, many commercial property owners are falling behind on their mortgage payments. In order to prevent an enormous commercial mortgage meltdown, the United States needs banks to start issuing more commercial loan modifications.</p>
<p>Commercial loan modification is simply the process of restructuring the terms of a commercial loan. It is a matter of renegotiating the loan so that it is more favorable to the borrower. For example, one can negotiate a lower interest rate with their lender, extend the term of the loan, defer mortgage payments, or even reduce the principal balance of the loan.</p>
<p>If a commercial property is not generating enough income to pay the mortgage or the operating expenses, a commercial lender may consider a temporary or permanent interest rate reduction. Reducing the interest rate will in turn lower the payment to allow the commercial property owner to increase the cash flow of the building. An interest rate reduction is ideal for property owners who have high vacancy rates. Lowering the interest rate should allow the borrower to service the debt while the vacant units are filled. On multi-million dollar loans, reducing the interest even just 1% can amount to savings of thousands of dollars per month.</p>
<p>Another common form of commercial loan modification is to extend the loan term. Extending the term or the maturity date of a loan can help commercial property owners avoid balloon payments and reduce their monthly mortgage nut. Many commercial loans have short terms, sometimes as few as 1 or 2 years. When the loan matures after only 1 or 2 years, the borrower is responsible for making a large balloon payment to pay off the principal balance entirely. Most lenders will consider a loan extension, but sometimes at a cost. </p>
<p>They may charge a point, or 1% of the loan amount, or extend the term at a higher rate of interest. Commercial property owners with loans nearing the maturity date may want to contact a commercial loan modification attorney to prevent this type of bullying by the lender.</p>
<p>In addition to lowering the interest rate or extending the term, a commercial mortgage lender may consider a deferment of payments as a form of loan modification. Sometimes called a payment moratorium, lenders may allow a borrower not to make a mortgage payment for 3 to 6 months. During this time, the borrower is able to build up cash reserves and rent out vacant units.</p>
<p>Before the economic downturn, property owners could refinance their commercial loans in order to lower interest rates and avoid balloon payments. Now, with the decline in property values, and the reduction in income of commercial properties, even borrowers with good credit are having their loan applications denied. </p>
<p>According to Deutsche Bank, by the end of 2012 over $153 billion in commercial loans will become due, and possibly $100 billion of that group will not be able to refinance.<br />What will happen then? Commercial lenders will have to consider loan modifications in order to stay in business. Until recently, many commercial lenders would prefer to foreclose on a building rather than modify the loan. However, today&rsquo;s political and economic climate will favor <a href="http://www.commercialloanmodificationexperts.com" target="new">commercial loan modifications,</a> and we may soon have government bailout programs for commercial lenders.</p>
<p>Commercial loan modification will not only help stabilize the economy, it will also salvage the deteriorating commercial real estate market. The United States needs commercial loan modifications. There is no better time than now to apply for a commercial loan modification.</p>

<p><b>Answer:</b> in MN since all the loans have changed - you will need 3.5% for a down payment on a new mortgage. You also will most likely NOT qualify for a mortgage since you just sold your home on a short sale.<br />
No lender will touch that for at least 1-2 years - so I'd say plan on renting and re-establishing your credit. Or go to mnrealestateteam.com and talk to one of the loan partners

<p>My question is this.  If WE buy a home in NC and I foreclose on MY home in FL after we have purchased the home in NC, can the mortgage company that holds the deed to the home in FL put a lien on the new house in NC?  I know that SC law allows that.  I own the home in FL by myself and we would buy the home in NC together.  </p>

<p><b>Answer:</b> I'm not a lawyer, so this isn't legal advice. For legal advice, you need to talk to a lawyer. (However, I am a licensed Realtor, so this is more than a guess.)</p>
<p>The mortgage company that holds the deed to your home in Florida can't put a lien on the new house in North Carolina. The mortgage is secured by the Florida property, not by your possible North Carolina property.</p>
<p>However, you could still run into all sorts of problems. Lenders generally (and particularly in the credit card field) have started including provisions that say that if you're delinquent on ANY payment from ANY lender, they have the right to raise your interest rate, reduce your credit, etc. I don't know your lender, so I don't know if the mortgage you hope to get in North Carolina might contain any such provision.</p>
<p>Further, though it may not matter, the Florida lender might become even more difficult to deal with if you purchase the North Carolina property. Lenders are more flexible when dealing with owner-occupants. Your Florida property, however, would be considered a second home when you buy the North Carolina one. I've heard of lenders requiring investors to pay money in order to get the lender of one property to permit a short sale.</p>
<p>Have you asked the Florida lender for forebearance? Or for a restructuring of the loan conditions. That's not a short sale or foreclosure, just a modification of the terms of the loan.</p>
<p>One technique you might consider for the North Carolina property, if you buy it. Immediately move it into a land trust. You and your wife would be beneficiaries of the land trust with power of direction. However, to help shield the trust, add another beneficiary with at least 10% ownership. Someone unrelated to you or your wife. The trust can be structured so that, when you sell the property, the 10% owner doesn't receive any profit or benefit. But putting it into a land trust will shield the property from suits, liens, and judgments. More info at http://www.landtrust.net</p>
<p>However, your best bet is to check with a real estate lawyer licensed in North Carolina.</p>

<p><b>Answer:</b> The house is going to transfer ownership, but that doesn't mean you're going to have to move.  If you want to take over payments, you have to make a deal with your landlord to buy the house in a way that satisfies the bank.</p>
<p>If that doesn't work, you then have to make an offer to the bank for the same thing.</p>
<p>Neither of them are under any obligation to sell to you, though, and the new owner (either the bank or whomever they sell to) can evict you at will (30-day notice required).</p>
<p>The forclosure is between the bank and the owner.  You have no grounds to interfere.</p>
