Question: Can you do a short sale without the individual having a NOD in hand?

Meaning...if they are in Pre-foreclosure--30-90 days in arrears, can you negotiate directly with the bank on the Short Sale, if the property owner can prove hardship prior to the NOD. Or not so much...Either direct purchase, or subject-to.

Answer: I do short sales for a living and different lenders have different guidelines. There are some that will allow a short sale even if the mortgage is not late and there are some that require 1-2 months of being late.

Question: Where Can I get Foreclosure Listings?

I've been looking at some Foreclosures listings and I'm wondering which companies are real and which ones are not. I have a partner who purchased from the auctions, but he ended up paying 80% of market value on a "good deal" I've heard of one company called 21khomes.com that sales homes for 30 cent's on the dollar. I've heard that they are legit. They claim to be direct with the banks. Only trouble is that they want proof of funds before they will show foreclosure listings. Is this normal?

Foreclosure listings are accessible through a range of media. The cable broadcast, local postings and the county office are among sources of this information. Free information of these listings is however found in a few dedicated websites. These sites have deals with the government for example to host their deals.

Government websites include all types of foreclosures but may necessitate that you access more information from a supplementary source. Local authorities hold records as to the foreclosures in the area you desire and offer the same free of charge. The investor can access the local authority website and check for deals of interest without having to make any payment.

Secondary lenders are a good information source for deals of this nature. These firms have websites that list any deals you may be interested in. Though owned by the government to a large extent these firms are largely independent, offering comprehensive information and deals on properties looking to foreclose.

Real estate agents are a worthy source to consult especially if they have a good grasp of the foreclosure market. The agents assist in faster deal hunting and rarely charge the investor for the search. State laws concerning the trading of such deals should be in the investor’s knowledge to prevent future inconveniences. Local banks and mortgage companies list foreclosed property through the local listings which is an easily accessible medium.
