One option is a 'deed in lieu of foreclosure.' Simply, a deed in lieu of foreclosure is giving back the property to the lender if the borrower is no longer capable of paying for the remaining balance of the loan. Both the lender and the borrower then enter into an agreement that the remaining balance of the defaulted loan is forgiven. The borrower is now free of any obligation to pay the entire loan.

Pretty simple isn't it? Or is it that simple?

First, a deed in lieu of foreclosure could only be possible upon the lender's consent. Convincing a lender to sign a deed in lieu of foreclosure may be extremely difficult. What lenders want is cash. Not another property to be sold. This is especially true if they already have in their possession a number of foreclosed properties or properties with a lien.

This difficult situation becomes impossible if you owe more than the value of the property. A lender doesn’t want to possess a losing piece of real estate. Instead, they’ll advise default homeowners to put the property on the market for a few months just in case it can be disposed of through a short sale. While this is another option of foreclosure prevention, a short sale has its own pitfalls. Either way, you will lose your home. It's just choosing the lesser evil.

To avoid this dilemma, homeowners resort to a much wiser alternative. This alternative is called loan modification. The greatest advantage to executing a loan modification is that you are given a choice to keep your home. This is done through a negotiation with your lender to adjust the terms of your existing mortgage. Through loan modification, the payment for the current month and the succeeding few months there-after could be suspended. The paying period can then be extended thereby reducing the monthly amortization. Depending on the newly agreed terms, the interest rate or even the principal amount could be reduced to a level you may not even expect.

Answer: Before choosing to go with the foreclosure, you should look into a few other options first. Refinancing is the option that most homeowners attempt first, but credit/income and tighter lending have precluded most homeowners from qualifying for a loan right now.

Either way, you should list the house on the market just on the off-chance someone wants to purchase it before the foreclosure goes through. You can also try to work with the lender for a short sale, where you'd sell the property for less than what you owe on it. At least it will pay off the loan and save your credit a bit.

If that doesn't work, ask the lender about giving a deed in lieu of foreclosure. That works as just giving the property back to the bank, and they can't go after anything else. They accept the deed instead of foreclosing or paying the loan, so there's nothing else for them to go after. This is only slightly better than a foreclosure, but anything you can do to preserve your credit will help at this point.

It will depend on how the bank pursues the foreclosure if they can sue you for another judgment and go after any other assets. With just the foreclosure, though, they are not entitled to anything else. You pledged the house as collateral for the loan -- not your car, 401(k), or prize racehorse. So all that they can take as payment for the loan is the house.

Look up California's state foreclosure laws and consult your loan documents to determine what kind of foreclosure the bank can proceed with (Judicial or Non-Judicial). That will tell you if they can sue you afterwards and try to go after any other assets.

Banks rarely sue for deficiency judgments, though, since they know that foreclosure victims don't have a lot of extra cash or even the ability to borrow any money. It costs the lender extra time to sue you and there's no guarantee they'd be able to collect on the judgment, so most don't bother with the judgment at all.

After seeing our real estate driven economy sag and bring with it dark days, closed stores and unhappy homeowners, perhaps the Denver market and Castle Rock in particular is coming out of the tunnel into the sunlight.

On May 26, 2009, the S&P Case-Schiller home price index in twenty select markets was released. The Denver market saw the nation's smallest quarterly decline and, for the past month, actually saw home sales rise. Denver shone as one of only three markets with an increase.

Each Saturday the Denver Post prints the Colorado Weekly Homebuyers List sorted by county. Of Castle Rock's three zip codes (80104, 80108, and 80109), sales last week totaled 37 homes. If you look up this week's 37 sales on the Douglas County Assessor and Public Trustee web sites, a number of interesting and illuminating facts emerge:

* - of the 37 Castle Rock homes sold, five actually sold for an increase over the amount previously paid- a bright sign.

* - 11 of the homes sold were newly constructed homes- another ray of sunshine.

* - On the dark side, Foreclosures hurt. Although only 7 of the 37 homes sold were foreclosure related properties, the amount of money lost was far and away the leading cause for losses in Castle Rock's real estate market. Two of the foreclosed homes were sold at a 33% loss from their previous purchase prices of $795,000 and $485,000 respectfully. That erased over $430,000 from our economy on these two sales alone. The remaining foreclosure sales were from 9% to 29% off their previous sale prices.

* The most expensive home sold was for $1,425,000, at a loss of $125,000 or 8.1%.

* The least expensive home sold in Castle Rock was for $118,000, a loss of $45,900 or 29%.

This week's sales were burdened by a 19% foreclosure rate. Although not a radiant percentage, it is a far cry from earlier weekly figures with 50% or more foreclosures in the mix.

Makes you want to buy a flashlight or two to wipe away the darkness.

The dark and dank problem that has not seen the light of day is the problem with getting a new mortgage. There just isn't enough money out there to lend. There has to be a better, brighter, more illuminating answer. Problems like this don't have to have three or four sides. We can make a icosahedron of bright, illuminating answers if we just think outside the box. We don't have to wait for the geniuses in Washington and Wall Street to bring the light. We can shine right here in Colorado.

Question: What are each of the steps of conducting a sheriff's sale on a home that has been foreclosed?

What has to be done? And after the sale, how does the buyer of the sheriff's sale get the people to move?

Answer: This can vary state to state and even county to county. In ours this is how it goes. The house sells at the courthouse for the taxes due (for tax foreclosure) or it sells for the balance on the loan. If it is for the loan the bank holding the loan will be there to be sure they at least get what they are owed. Once the sale is done the owner has 30 days to redeem the property. If they dont then the new owner gets a sheriffs deed. Once that has happened the old owners have to move out. Usually the sherriff will go with you and escort them from the property. This is why most move out before its done as once the sheriff comes they can only take what they can carry out.

Question: How long do I have to get out of a foreclosed home in CA after the notice of trustee sale is posted?

I am renting a couple rooms in a house located in California. Unfortunately there is not a lease agreement. They posted the notice of trustee sale on the door, the auction was supposed to be 2 days ago but it has been postponed a week. I am packing fast but don't know how long I have, the number on the notice just puts me on hold indefinately. How long? do they post an eviction notice? I've never had anything like this happen.
Theyhave not posted an eviction notice yet, when would they normally? Thanks

Answer: You have to leave only when the eviction notice has been served, not when the sale has closed. When the eviction notice is posted it will specify the date on which you must vacate.

The new purchaser may offer the place for rent, for all you can tell now.

What's positive about being foreclosed upon or selling your home for less than you owe? Well, for most people, not much. Yes, you are relieved of an onerous mortgage loan and you are now free to find housing that is more affordable within your budget. But not everyone fully understands the lingering effects of a foreclosure as it pertains to the mortgage debt forgiveness. This applies to foreclosures, short sales and a deed in lieu of foreclosure.

Foreclosure can be one of the most devastating things a homeowner can face. At a minimum, they will end up with damaged credit. Until recently, the tax laws further penalized homeowners who were relieved of mortgage debt obligations with additional taxation. Homeowners owe taxes on the amount of the debt obligation from which they are relieved. For example, let's look at a short sale. If a bank agreed to accept $200,000 as payment in full to satisfy a mortgage where the homeowner owed $250,000, the homeowner would owe taxes on $50,000. They were relieved of repaying $50,000 in mortgage debt. When you are relieved of debt, you are actually benefiting because you no longer have the obligation to pay it back. Hence you must pay tax on this "unrealized income" even if there was no direct corresponding benefit, such as equity proceeds from a sale. At the same time, how is the homeowner who just lost everything going to be able to pay tax on the differential of the satisfied mortgage obligation when they received no tangible proceeds from the sale?

As we have just seen, the amount of debt forgiveness is considered income. All debt forgiveness, not just mortgage debt, results in reportable taxable income. Many people who've walked away from their homes have found this out the hard way. Many found out at the end of the year when they opened their mail and found they'd received a 1099C. The 1099C is the IRS form that the creditor gives the debtor when they have forgiveness of debt.

Today we have a record number of foreclosures. When banks and lenders sell homes they've gotten back during the foreclosure process they are less concerned about the bottom line and more concerned about being rid of the collateral. This can result in spiraling downward values in areas or communities where foreclosures are high. Large numbers of foreclosures like we are currently experiencing are hurting our overall real estate market valuations.

One solution to the problem has been to encourage those homeowners in distress to work with the bank to sell the home while they continue to occupy the property. This may result in a short sale, whereby the bank agrees to accept less than is owed on the outstanding mortgage. Together, the bank and homeowner work to sell at the highest possible price given the conditions of the prevailing market. Working together allows the home to be maintained and occupied during the course of the sale. This generally is less costly to the lender and is one of the reasons why they entertain short sales.

In general, short sales are less "shocking" to the market values in comparison to a lender going through the foreclosure process and then reselling the property as an REO. This should be encouraged where possible.

Tax wise, homeowners still receive a 1099C. From a credit report perspective, the lender usually won't report a foreclosure against the homeowner if they sell with a short sale. A short sale in that instance will be beneficial to the seller's credit and may be helpful when the seller becomes a buyer and wants to obtain another mortgage in the future.

In Minnesota we have a unique situation regarding foreclosures. For owner occupied properties, we have a 6 month right of redemption from the date of the Sheriff's sale. Because of the long redemption period, during which no payments are due, many in Minnesota are opting to be foreclosed upon instead so they can live in the home for free. You see this occurring most often where preservation of a one's credit rating is no longer important to the homeowner.

To encourage lenders and homeowners to work together, the government has just created a new law. The law is H.R. 3648, entitled Mortgage Forgiveness Act of 2007 and was signed into law as of mid December 2007. Here's what the law does: it waives taxes for debts forgiven from the beginning of 2007 to the end of 2009. This means no more 1099C, at least during this time frame.

Can you see the implications? This means that homeowners and lenders can work together to either sell or refinance the existing mortgage debt, without having to recognize the taxes due on the amount forgiven. It provides an incentive to protect your credit and work out an acceptable solution, such as a short sale. Income taxes are taken out of the equation since there isn't anymore inherent tax liability from mortgage forgiveness.

This should slow down the foreclosure crisis and allow values to stabilize. This is a good law that should help ease the mortgage and real estate crisis we are facing today.

A friend was complaining the other day about only getting a one percent return on her bank CDs. I suggested she become a private lender. "You could earn eight to twelve percent on your money," I told her. "And even better, it would be secured by real estate."

"When would I get my money back?" she asked. "And how do I know it will be safe?"

"It's safe to the extent that the house has built-in equity at the time of purchase," I assured her. "I only buy houses that can be acquired at a discount, and the value increases after the house is repaired. When it's sold to a new homeowner, the title company writes you a check for the amount of your loan plus the accrued interest. Does that sound reasonable?"

"I guess so," she agreed. "But what if you can't find a buyer? What if you don't have any money to pay me back?"

"If I can't find a buyer, I'll have to ask for a loan extension, and that's more interest income for you," I said. "You'll get your money back with the sale of the house, and if I priced it properly, it will always sell for more than it cost."

"Hmmmm," she said. "I'll have to think about that." So she's currently considering whether she wants to join in my mission of turning empty houses into homes again. I hope she does.
