Answer: It's very brilliant idea actually, but is important for you to make an agreement with the owner of that propertiy(s) in order to the buyer not contact directly with the legal agents of the party(s) of that properties. Because, when you build that website, you must put the address of that properties including office or agents. It's better you make agreement for example : take only 2% from real estate price ( making agreement with general marketing manager of real estate ) or if they will not accept your propocal, try to make agreement with seller ( agents ). If you want to be more specific on your situation, I can also give a better answer.
If you are in payment default of your business loan the process can typically take some time before the lender will actually foreclose on the property. The lender will typically look to the personal guarantors (if available) to make payments on the obligation. If guarantors are unable to pay (as disclosed above), the property will be foreclosed upon and liquidated. This entire process can vary from lender to lender, but from my experience can take as little as 45 days after payment default has been declared.

The owner is still responsible for payment of property taxes. If you are unable to pay the property taxes you run the risk of the property going back to the county and sold at sheriff sale.

This process is a difficult and complicated one, and situations can vary by situation. I would advise that you (or whoever) work with your lender's managed assets / work-out group to figure out a payment plan.

Above all else, talk with your attorney and do it as soon as you can. Having your attorney work with the lender is always a good idea.

Some of the states require the mortgage holder to notify each tenant that the property is being foreclosed upon, when the foreclosure sale is scheduled to be held, and how their tenancy will be handled if the foreclosure is completed. If the rents are current, any utilities which are included in the rent must be paid or the full utilities charged to the unit must be returned to the tenant. Not to do so is a chargeable offense.

Don't cut your property insurance until after the foreclosure sale. You are liable right up to the last minute. Sorry for your troubles!

Does the "one-action" rule mean the California Banks can only choose one action over another by either Foreclosue the property and take whatever the proceed (which may be less than the loan amount )or take a Deficiency Judgement against the home owner?

Answer: Both judicial and non-judicial foreclosure are available, but the non-judicial deed of trust sale is overwhelmingly preferred.

California has a one-action rule, in which a lender must elect one action to take against the borrower if the borrower defaults. If the lender forecloses the deed of trust out of court, the lender has chosen one action and may not bring a lawsuit to recover a deficiency, which would be a second action. If the lender chooses to sue the borrower and obtain both a foreclosure order, and if the proceeds of the judicial sale of the real estate are not sufficient to repay the loan balance, then a deficiency for the balance is allowed. Such a suit is permitted as the lender's one action.

California lenders rarely elect judicial foreclosures.
Debtors may reinstate up to five days before non-judicial foreclosure sale.

Question: Property line problems--help please?

We bought and moved into our property 3 years ago. Recently, one of the foreclosed homes in the area sold and the new owners had the 30 acre property surveyed. The surveyors cut an angle across our back yard claiming it belonged to the 30 acre parcel that was bought. Our property is a perfect rectangle in measurements, so we know that something is wrong. The area of our yard has been maintained not only from our 3 years of living here, but since the home was built in 1979. We disagree with the new owners survey and have requested they redo their survey and include checking the line on our property to ensure the property lines do not overlap from a prior survey mistake. If the properties overlap, who has the right to keep the property?
By the way, we live in Michigan.

Question: Foreclosed/Bank Owned Homes Question?

Someone please tell me what the catch is in buying bank owned/foreclosed/probate homes. I went to Trulia.com and ran a search:

http://www.trulia.com/for_sale/North_Hollywood,CA/price;a_sort/

It returned tons of property with a listing price of basically nothing. How come everyone doesn't buy these deals real quick?

Answer: Foreclosures have a market price just like a regular home, of course cheaper. So the idea that foreclosed homes can be bought for pennies on the dollar is not the norm.
Foreclosed homes have a low price as they carry risk. Usually the buyer can not inspect the property and has to make a payment in full at the time of purchase.

I believe my father owned a house in SC but i live in Florida, he passed away and I was wondering how I would figure out about the house.
