<p><b>Answer:</b> No, you seem to be confusing families in foreclosure with the banks who took advantage of these people. </p>
<p>The government, through the Federal Reserve, is helping the banks by giving them below-market interest rates loans. Just last week, another $200 billion was made available to banks. They can trade in bad mortgage debt in return for Treasury securities.</p>
<p>That effectively means that the banks have absolutely no reason to work with homeowners in foreclosure. They know they can just hide the foreclosures later on and get free money from the government. So there's no reason to spend any of that free money on helping homeowners save their homes from foreclosure.</p>
<p>There has been a lot of talk about helping the homeowners, but nothing substantial has been done. The HOPE NOW and Project Lifeline programs involve about 6 lenders in the country total, and they are voluntary for the banks to participate in. Also, they do not offer any solutions that banks could not offer in the first place, making them completely public relations schemes.</p>
<p>So, the banks have all the low and no interest rate loans they can handle, which came care of the Federal Reserve. It's also not being discussed that easy credit and low interest rates created the housing bubble in the first place. So the Fed is just doing whatever they can to create another bubble somewhere to bail out this current bubble's crash.</p>
<p>Don't look at what the politicians in Washington are talking about. Look at what they do. They talk about helping families in foreclosure (even proposing funds of $30 billion), while freely giving out hundreds of billions of dollars directly to the banks. Maybe $30 billion for 300 million Americans; over $200 billion and counting for a handful of the largest banks. Who benefits from this?</p>

What are the dangers of buying a house in a newer built subdivisions<br />
at drastically lower prices than I could find any where else in the metro? How bad of a decision could it possibly be to buy one of these houses, I mean assuming it is in good shape, and not stripped, etc?<br />

<p><b>Answer:</b> If you don't mind being out there by your little lonesome... then the only thing I would check out first is whether this development was built in a flood plain and is it worth the commute to your job and your old grocery store? (just in case the infrastructure goes bankrupt too).</p>
<p>Here in CA we have this problem a lot. They ran out of room and somehow got the OK to build subdivision after subdivision in the flood plains. </p>
<p>Don't ever think that it will never happen. It does rain in California.<br />
And when your house sits in a designated flood zone... you are just waiting to be washed away one day.</p>

<p>WSJ's Sara Lin and Kelsey Hubbard on Pimco's Bill Gross', known as the'Bond Guru,' new gigantic home purchase in California. </p>
<p>The report,'Walking the Walk : How Walkability Raises Housing Values in U.S. Cities,' was commissioned by chairpersons for cities, a national network of urban leaders from the civic, business, academic and philanthropic sectors. </p>
<p>it's an critical point for home-buyers who try to identify which homes will hold their value, expounded Joseph Cortright, the report's author and a senior policy confidant to managers for cities. Cortright is an economist and president of Impresa, a Portland, Ore.-based consulting firm. </p>
<p>Walkable places have some of the best chances of performing well in years ahead, he revealed. </p>
<p>The analysis used exchange info from ZipRealty. It worked out walkability of the houses using the Walk Score algorithm, which grades addresses based primarily on facilities that are nearby, from restaurants and coffee shops to parks and libraries. Scores range between nil to 100, with 100 being the most walkable ; a score higher than 70 indicates it may be possible to get around in the area without using a vehicle. </p>
<p>Controlling for other considerations including a home's size, the amount of lavatories and bedrooms, age, neighborhood income levels, distance from the Central business district and access to jobs, the report found that an one-point increase in Walk Score is connected to an increase in home price between $500 and $3,000, depending on the market, according to the study. </p>
<p>The premium for homes in neighborhoods with better-than-average Walk Scores ranged from $4,000 to $34,000, according to the report. <br />Exceptions to the rule </p>
<p>But that premium wasn't found everywhere. In las vegas, walkability associated with lower housing values. Bakersfield, Calif, showed no statistically serious connection between walkability and home prices, according to the study. The report failed to analyze why houses in walkable neighborhoods did not bring a premium in those 2 places. </p>
<p>It's speculative, but in las vegas,'it might be that those areas that have the highest walkability are not the most attractive areas' in the metropolitan area, Cortright related. </p>
<p>Matt Lerner, chief technology officer of Front Seat, the software company behind Walk Score, claimed Bakersfield is rather sprawling and maybe never developed a healthy city center or clumps of walkable areas. </p>
<p>Or it could be that the volume of foreclosures and the macroeconomic trends with which these cities are dealing are overwhelming any positive effects that walkability could have on home prices, said Pat Lashinsky, Manager of ZipRealty. </p>
<p>'The effect is being masked,' he claimed. </p>
<p>Even in areas where walkability does statistically matter, the premium it affords isn't the same from place to place. Dense urban areas like Chicago and San Francisco showed higher price gains based primarily on higher Walk Scores ; in less dense markets like Tuscon and Fresno, home prices did not jump as much due to higher walkability. </p>
<p>Other metropolitan areas included in the study were : Arlington, Va. ; Austin, Texas ; Charlotte, N.C. ; Dallas, Texas ; Jacksonville, Fla. ; Phoenix, Ariz. ; Sacramento, Calif. ; Seattle, Wash. ; and Stockton, Calif. <br />There are environmental and health benefits from living in a place where the auto can stay parked. In promoting Walk Score, Lerner said his firm emphasizes how walking instead of driving can play a part in stopping global temperature rises and how folks who live in walkable areas weigh seven pounds less, normally than those that don't . Places with higher Walk Scores also often have better mass transit services, according to the report.<br /><strong>Lafayette, CA Real Estate</strong></p>

<p>Foreclosures are increasing nationwide. Homeowners desperate to stop foreclosure are falling victims to scams that promise to "rescue " homeowners from foreclosure. what these scams do is take your money, ruin your credit record, and wipe out any equity you have in your home.</p>
<p>Your mortgage lender or any legitimate financial counselor  can help you find real options to avoid foreclosure. If someone offers to negotiate with your lender and offers to arrange to stop or delay foreclosure for a fee, carefully check his or her credentials, reputation, and experience.  Lease-Back or Repurchase Scams. Be very suspicious if someone offers to pay your mortgage and rent your home back to you. Signing over the deed gives the con artist the power to evict you, raise your rent, sell the house, or steal the equity you have in your home. You will still be responsible for your mortgage, so if the con artist stops paying it, your lender would have the right to foreclose on your home, and the foreclosure and any other problems would go on your credit record.</p>
<p>Refinance Fraud - Look out for people posing as mortgage brokers or lenders and offering to refinance your loan so you can afford the payments. Con artists may trick you into signing over the ownership of your home by saying that you are signing documents for a new loan. Signing over the deed to your home exposes you to the dangers described above. Even if you are a victim of fraud, you could still lose your home.</p>
<p>Bankruptcy Schemes - Several scams attempt to abuse the bankruptcy laws. For example, a con artist may ask you to give a partial interest in your home to one or more persons. Each holder of a partial interest can then file bankruptcy, one after another. The bankruptcy court will issue a "stay "order each time to stop foreclosure temporarily. However, the stay does not excuse you from making payments or from repaying the full amount of your loan. In another kind of scam, a con artist may offer to obtain refinancing or negotiate a payment plan with your lender. If you may make payments to the con artist, he or she may keep the money rather than pay the lender on your behalf. The con artist may even file a bankruptcy case in your name, as a part of the scam.  Bankruptcy laws provide important protections to consumers. Scams can only  temporarily delay foreclosure. Signing over ownership of your home, or even partial ownership, can result in serious financial harm.</p>
<p>How do you protect yourself? Know what you are signing. Read every document you sign. If a document is too confusing, pay the extra money to seek advice from a lawyer or an approved, trusted financial counselor. Never sign documents with blank spaces that can be filled in later. Never sign a document that contains errors or false statements, even if someone promises to correct them later. That is the oldest trick in the book, these people count on gain your confidence to defraud you.</p>

By signing over your deed, you lose your rights to your home and any equity built up in the home.</p>

Lenders are often in the best position to help, especially if you are current on your loan or not seriously late on your payments. Your mortgage lender or mortgage servicer may be able to identify options to help you bring the loan current or to modify your loan. You need to find counselors approved by the U.S. Department of Housing and Urban Development (HUD).<br />

<p>If you use this key it could save your home from a foreclosure auction on the courthouse steps. This key is an item that is often overlooked.&nbsp; However, it is the key to any mortgage and to every right of foreclosure initiated by the lender. Without it the lender has no authority to foreclose on any property.</p>
<p>The keystone to all of this is the contract. Without a contract there can be no mortgage. The mortgage is not a stand alone document. </p>
<p>Challenging the banks right to foreclose is pretty agressive and it is pretty powerful.</p>
<p>There are many successful challenges made every day and hundreds have already challenged the banks right to foreclose and have won. So can you, if you take action.</p>
<p>The mortgage contract is often lost or destroyed and cannot be produced when a demand is made for it's production. This is very sigificant and powerful to your case. It can mean the difference in losing your home and keeping it. </p>
<p>The lender must produce the note/contract or offer an explaination why it cannot be produced. Usually it has to be a very substantial reason why. Something along the lines of a fire or flood destroyed it. Simply claiming it was destroyed and preserved digitally or misplaced is not sufficient in most cases.</p>

<p><b>Answer:</b> You did not say where you are from, also in the U.S.A you can get loans from private institutions that sell mortgage back securities and also from banks and fha loans that are backed by the government.  </p>

Why can't home mortgages be reset to the current value that way monthy payments are reduced in half to keep home owners in their homes, help or stop foreclosures.  </p>
<p>I would like to see that happen than tax credits. And then the government can give all these tax cuts to the mortgage company's to make up for the amount they are loosing from the mortgage cut.</p>
<p>Did I explain that right? </p>
<p>Anyways I am just courious if this has come up, Why it couldn't being down, what damage would it  cause, if any, if this would happen  and so on.</p>

<p><b>Answer:</b> You know you are my favorite right?  So I am not going to tell you the flaws in your idea BUT maybe offer a suggestion that would work in a similar way.</p>
<p>With the homes that are in foreclosure why not offer 60 year fixed rate mortgages?  Then the home owner can choose to pay around 1/2 of the payment they originally had.  The bank still is getting their principal back (just much slower) and they will get a HECK of a lot more interest over the longer period of time too.  </p>
<p>Then IF the market goes back up the home owner can choose to sell and get out of their 60 year mortgage!</p>
<p>I like your thinking it just is a little off on this one!</p>

Things were worse in the 1970's by all economic indicators. There were no foreclosures then because few could afford the 15% mortgage rates.

In Colo, with a quitclaim deed leaving the house to me, can they legally foreclose on the house or can we keep it even if payments are not made? I'm confused on "due on sale" clauses and liens and such issues. Please help me, especially if you're knowledgeable on these areas. Thanks!

<p><b>Answer:</b> they can and will foreclose unless you get ahold of them and make arrangements, it is actually not that cost effective for the banks to foreclose so they will try and help if you make the initiative if not...</p>

<p>Facing the loss of you home can be a scary thought,&nbsp;and it's happening to people every day across the country.&nbsp; There are some options out there that may be able to stop the foreclosure all together or possibly come up with more time to help find a resolution to your situation and provide foreclosure assistance.</p>
<p>While it is crucial to keep your mortgage up to date if at all possible, sometimes circumstances prevent you from doing so.&nbsp; If you think you might even miss one payment, contact your mortgage company.&nbsp; Communication is essential.&nbsp; For the most part lenders will work with you and will postpone a foreclosure to try to help buy you some time to find a solution to your problem.&nbsp; It is not uncommon for the lender to want written documentation that you are putting a plan in place to prevent the foreclosure.&nbsp; An example would be an application for a loan modification or paperwork showing that you have placed your home on the market.&nbsp; Some lenders will even work with you to modify the loan themselves.</p>
<p>There are also these possible options available from some lenders:</p>
<p><strong>Reinstatement:</strong> Lenders are always willing to discuss accepting the total amount owed in a lump sum by a specific date. Forbearance may accompany this option.</p>
<p><strong>Forbearance:</strong> Your lender may allow you to reduce or suspend payments for a short period of time and then agree to another option to bring your loan current. A forbearance option is often combined with a reinstatement when you know you will have enough money to bring the account current at a specific time. The money might come from a hiring bonus, investment, insurance settlement, or tax refund.</p>
<p><strong>Repayment plan:</strong> You may be able to get an agreement to resume making your regular monthly payments, plus a portion of the past due payments each month until you are caught up.</p>
<p>If you think that your situation could be long-term or permanently affect your ability to bring your account current, you should call your lender to discuss these possible options:</p>
<p><strong>Mortgage modification:</strong> If you can make payments on your loan, but don't have enough money to bring your account current or you can't afford your current payment, your lender may be able to change the terms of your original loan to make the payments more affordable.</p>
<p><strong>Partial Claim:</strong> If your mortgage is insured, your lender might help you get a one-time interest-free loan from your mortgage guarantor to bring your account current.</p>
<p>Another option is that you can request addition time from the court.&nbsp; Usually this involves utilizing the services of an attorney although sometimes you may be able to find someone at the courthouse that is willing to assist you.&nbsp;</p>
<p>Filing bankruptcy is another option if there are not any other alternatives.&nbsp; Most bankruptcy laws protect a primary residence and allow you to keep your home.&nbsp; It is imperative to consult a qualified bankruptcy attorney if this is what you are considering.</p>
<p>If you are facing foreclosure on your home, rather than ignore it, hoping it will go away, be sure to be in contact with your lender right away to seek out foreclosure assistance.&nbsp;</p>

Bankruptcy could relieve you of some (or all) of your credit card and other unsecured debit payments which would leave you enough to make house payments but if you are in  foreclosure you have likely missed so many payments that you don't have enough cash to cover them all.</p>

Don't think we can sell in time, and my FICO score keeps taking a hit .We live in Tennessee. house worth $290,000, some homes around us priced less. My income higher than spouse. Spouse filed chapter 7 in June.  Spouse not on this mortgage was in chapter 13 when home purchased one year ago.

<p><b>Answer:</b> You should have read your paperwork when you purchased. Thats why 30 yr fixed is the way to go. Good luck; I doubt that there is much you can do with the market as bad as it is now and only getting worse as more people in your situation are hitting their new payments. You may find a bank to help, but be careful, as with your previous experience it should show you that banks/ brokers in this country are pretty much out to screw people in the same manner as used car salesmen these days. I  would stay away from any business on the internet especially.</p>
