Question: My house was foreclosed on. Has deed been transferred if I have not personally signed it over yet?

My house was foreclosed on in June of 07. 5 days ago I received a final eviction notice from the sherriff. Where do I call to find out if the house has actually been sold at autcion & deed has been transferred as I have not personally signed it over yet. I know that if you don 't sign it over they can go to court and get the deed that way. I live in Maryland.
First of all, thank you to the people who have answered my question. I need add a detail. I spoke with a realtor and she also told me if I did not sign the transfer of deed, the courts could still get it without my signature, this I know. However, she also stated that they HAVE to have the deed in order to put me out, that until they do, I technically still own the house. I'm trying to find out who to call to obtain this information. Does anyone know how I can find a number or if I can get this info online?

Answer: If you have a mortgage what you have is a Warranty Deed, not the same as having a Deed. Your signature is not required. You no longer had any legal rights to the property when the clerk's representative said "sold" at the auction. Sold does not have to mean that another person purchased the property, it reverts back to the lender if the highest bid was not enough to cover the default amount plus costs of foreclosure.

Question: how do I find out information about an abandoned house in Pasco County, Florida?

We want to buy a house that has been abandoned but can't find out who owns it. We have found the original owner's info online but there is no contact info, or which bank owns it if it has gone into foreclosure. Answer: The tax assessor will know who owns it. You are on your own to contact them, they have no obligation to tell you how to reach them. You can obtain bank information, but unless the bank owns it they can't legally tell you anything either.

It does not sound like this is abandoned, only vacant. Abandoned property ends up belonging to the state, which sells it.

Answer: You might look in your local newspaper and find a listing that say "Foreclosed Homes" Call this agent to see if they will send you a list of their foreclosed homes.

Some will but most would want to see if they can get enough information from you to get you pre-approved prior to sending you a list if they would send it at all.

Most real estate agents think that if they supply you with a list of REO homes, you might not come back to them if you decide to purchase a REO home off a list they provided to you.

There are very few free web sites that will list REO homes for sale.

Question: Can I fire my buyers agent I signed a contract?

About 2 months ago I signed a buyers contract with him for 180 days.

1. I never got a copy of it even though he said he was going to send me one.
2. We had an appointment to see a house at 1pm, he showed up at 3pm.
3. My financial guy told me not to see homes over 200k but he is constatly showing me homes that are 220/230
4. He tried to sell me on the first home we have seen even
though it was completely crap.
5. He acts like getting 10,000 off a house that is 230,000 is a big deal and tried to sell me on it and the house needed work. Even though we same a similar house a few blocks down that was asking 210,000 that did not need repairs.
6. He is ALWAYS LATE
7. I asked him to show me foreclosed homes and he never has, he just shows me mls.

I don't believe he is looking after my best interest.
Can I get out of the contract?

Answer: First of all, 180 days is a LONG time to contract for a buyer's agent. Most of the ones around here are 90 days or less.

Call and email your agent, and tell him three things:

1. Tell him that if he doesn't provide you with an executed copy of your agreement by the end of the business day, you will have no choice but to report him to the real estate board in his town. Review the document to see where you stand, and what the conditions are for non-performance (I'm betting that there aren't many

2. Request a meeting with him AND his broker within 48-72 hours to review a list of available homes $200,000 AND UNDER. Also ask for a list of foreclosed homes that he can show you.

3. Explain that you are fed up with his tardiness. It is unprofessional and you expect him to be prompt to any future appointments. (Say this in front of the broker). You are letting him push you around, and that's not smart from ANY consumer standpoint. REFUSE to see homes outside of your price range. Just don't get out of the car! Being two hours late for an appointment is inexcusable.

On the foreclosed homes, he may not be savvy enough to be able to figure out which homes are foreclosed and which ones aren't, and may be too lazy to figure it out. With his broker there, he might be more inspired. *g*

Just remember, YOU are the one making the offer, not your agent. If you choose to offer $200,000 on a $230,000 house, that is YOUR choice, not your agent's. He may recommend against it, but he is obligated to present your offer.

Basically, you need to stop whining and take some positive action. You are in control of this transaction, not him, so TAKE CONTROL. If he senses that you are more trouble than he is willing to deal with, he may offer to tear up the agreement.

HUD is short for the federal agency called the "Department of Housing and Urban Development." The agency offers homes to "owner-occupant purchasers"; in other words, to people who are buying the home as their primary residence.

However, there are opportunities for us, as investors, in this market. Owner-occupants have first crack at foreclosed properties. But, if these re-possessed properties aren't sold, then we can have a shot at them. In this session, I'll show you how to approach this market. HUD Repossessions A HUD home is a 1 to 4 unit residential property acquired by HUD as a result of a foreclosure action on an FHA-insured mortgage. When this occurs, HUD repossesses the property and offers it for sale to recover the loss on the foreclosure claim.

All HUD properties available for purchase by the public are offered for sale at Internet listing sites. Go to
www.hud.gov
to find these sites. They're maintained by management companies under contract to HUD. The site also provides complete information on HUD rules, programs, and properties and can direct you to realtors in your area affiliated with the HUD programs.

Real estate brokers registered with HUD may submit an offer and contract to purchase on your behalf. HUD pays the real estate broker's commission, if included in the contract. At the time of this writing, the highest maximum FHA mortgage is $362,790 while the lowest maximum amount is $200,160.

Generally speaking, the conditions of HUD homes range from average condition to terrible. Foreclosure is never a happy time for the former owners so they may not have kept the homes in good condition or even damaged them. In addition, if the properties are vacant, there may be damage from vandals.

To present an offer on a property, you must make it through a realtor representing HUD in your area. Contact that realtor and arrange for a walk-through of properties to find out what condition they're in.

HUD prefers to sell its properties at fair market value. However, the condition of these properties does vary. So, if you're really on top of local property values, you may be able to find some real bargains. Financing for HUD Homes HUD doesn't make direct loans; instead, it works with lenders in a variety of programs. As an investor, you may be able to get a property for 10% down. HUD tends to like offers that are a cash-out; that is, you find your own outside financing.

If a HUD home is in really terrible condition, you may be able to get a fix up "allowance" from HUD. The allowance may take the form of a price reduction or a special loan. To get the allowance, you must make it part of your purchase offer.

In the event HUD wants to move a property quickly, you may be able to get a price reduction ("bonus"). So, if you've got your financing in place and can close within a week or so, you can get a real bargain. Do Your Due Diligence! Always have the property inspected by a professional before you commit to a purchase. In fact, HUD doesn't like to tie up homes with contingencies that involve inspections so you'll need to have the inspection done beforehand, anyway.

Key Point: Understand HUD rules and regulations thoroughly before making offers for foreclosure properties. Also, establish good relations with local HUD-affiliated realtors so you can stay on top of the market.

You have to get a mortgage and the lowest downpayment you can do right now is with FHA financing and if I am being totally honest, foreclosures are HARD to get approved by FHA. I am going through it right now and its been a CHORE...lots of work and time invested but its working in the long run. FHA has strict rules about the condition of the house so if there are problems with the house they could flag it and your financing would fall apart. Conventional mortgages right now require 10% down which sounds way out of reach for the two of you.

Answer: you can go onto bank websites and find their asset manager. they should be able to tell you if they are handling their foreclosures or if they are farmed out to a real estate agent. some banks will have foreclosed properties on their websites. dont forget credit unions also.

you can also try the county that you live in to see when they are selling/auctioning the properties they have. check with different counties tax assessors offices for homes that are being sold for tax default.

the real estate market is very slow right now so you might have some success searching online. however, i find that this ends up being a lead generating tool for agents and companies that give out dated information.

once you find these homes you might want to contact a real estate agent to find out the different ways you can make offers on these homes. also check with a lender to find out the qualifications necessary to acquire these home. there are some "hard money" lenders that wont rely toooo much on your personal standing. (hard money: lenders that charge a higher interest rate with usually more relaxed lending practices. they also loan to those who are looking for investment money to fix up homes to flip it. they are looking for a fast return on their money.)

In the third quarter of 2006, Detroit real estate suffered more foreclosures than other states; in fact, bank foreclosed on four times as many homes there as compared with the national average.

RealtyTrac is an online foreclosure resource, which documented that Detroit’s mortgage failures were up 43% since 2005.  Some contributing factors have been the steadily rising home prices, as well as the resetting of variable mortgage rates.

In early 2007, Michigan’s unemployment rate was 7 percent, the highest in the country, as documented by the Bureau of Labor Statistics.  That rate of joblessness was began around 2003, when Ford made considerable cost cuts and eliminated jobs in its efforts to meet Japanese competition.

Loans carried by “solid” borrowers

Ironically, a higher percentage of Detroit area mortgages are prime loans, made to the most credit-worthy borrowers.  Nearly 80 percent of the loans originated in 2006 were “A paper,” a few points higher than the national average.

Even those homeowners in Detroit who are making timely mortgage payments are feeling the impact of the high foreclosure rate.  As neighbors’ loans default and Detroit REOs rise, prices quickly dropped 10 to 20 percent.  This kind of decline in value can leave homeowners upside down, owing more than the property is worth.

There is a type of “guilt by association.” A whole neighborhood is stigmatized when auction signs and bank foreclosures appear.  The good neighbor, who meets his payments and maintains his property, is nonetheless negatively impacted.

Even on Wildemere Street, an upscale Northwest Detroit neighborhood, there is some adversity.  The two-car garage, Tudor homes sell for twice the city’s median price, yet one fourth of the houses are vacant.  Many of the unoccupied properties display auction or foreclosure signs.

Taking profitable advantage of Detroit foreclosures

While the statistics regarding Detroit real estate seem a bit depressing, from an investor’s point of view, there may be ample opportunity.  The 30th Street area, a couple of miles from City Center, is nearly gutted, with the majority of row houses empty and dilapidated.  To some savvy investors, this bottomed out market phase can be the raw material for rebirth and even capital growth.

In Delray Beach, Florida, for example, builder Frank McKinney bought an entire block of similarly derelict homes on what is now called “Bankers Row.”  Many of the small bungalow style homes were vacant and unsecured.  McKinney applied his skills to renovate and beautify the block with municipal cooperation.  Buying the properties for back taxes, he created a new look to the block, which was then dual-zoned.  Today, Bankers Row is fully occupied by a mix of residential and commercial occupants.  Colorful paint schemes suggest Caribbean charm, and pretty awnings make the little structures seem just a bit larger, with a hint of whimsy.  Similar neighborhood uplifts followed the Bankers Row success story in Delray Beach, converting what were considered dangerous neighborhoods to communities.  Delray does not have an auto industry.  The major source of jobs is hospitality, mainly restaurant and bar services.  But in the case of that Florida city, perhaps the homes brought the people and the jobs.

Can Detroit be the next such revival?  With the severely discounted foreclosures and ample profitable opportunity, the answer may indeed be a resounding yes.
